Furnish and deliver containers for acceptance of friable and non-friable asbestos waste to the reclamation center, and provide for removal and transfer to another disposal site when filled for the period January 1, 2025 through December 31, 2025 with option to extend for one (1) additional one-year period. Notices of revisions or addenda will also be published in an official County newspaper and copies of the addenda will be provided to prospective bidders in writing by certified mail or by certified facsimile transmission or by a delivery service. N.J.S.A. 40A:11-23(c)(1). In addition to the notices, the actual revisions or addenda will also be posted to Purchasing's website. THIS IS AN OPEN-END SUPPLY CONTRACT. The goods and/or services are on-call if and when needed throughout the duration of the contract term. The quantities bid are estimates and the County reserves the right to increase or decrease quantities, using unit prices, by up to a maximum of 100%. Pursuant to N.J.A.C. 5:30-11.1 et seq., orders placed within the minimum and maximum number of units shall not be considered a change order. The County may terminate the contract whenever the amount incurred under the contract exceeds the maximum number of units. The Contractor will be required to comply with requirements of N.J.S.A. 10:2-1 (AntiDiscrimination in Employment), N.J.S.A. 10:5-31 et seq. and N.J.A.C.17:27 et seq. (Equal Employment Opportunity), 42 U.S.C. 12101 et seq. (Americans with Disabilities Act), N.J.S.A. 52:32-44 et seq. and (New Jersey Business Registration). The County of Monmouth reserves the right to reject any or all bids in accordance with applicable laws and regulations. 25.The County may include in any contract, the length of which is for three (3) years or less, the option to renew the contract for either one (1) two-year period, or two (2) one-year periods. Any renewal option shall be exercised by resolution of the Board of County Commissioners upon a finding that the services are being performed in an effective and efficient manner. The decision to exercise (or not exercise) the renewal option(s) will be at the sole discretion of the County. 26.If the bid notice to this RFB indicates a renewal option(s), the bidder, by submitting a bid, agrees to continue providing the products and/or services under this bid for the additional renewal year(s) if the renewal option(s) are so exercised by the County. 27.The terms and conditions of the contract shall remain substantially the same for any renewal term(s). A change in the of the original contract amount for each renewal period, if any, will be in accordance with the requirements of N.J.S.A. 40A:11-15. 18.If the bid notice to this RFB indicates a bid guarantee is required, a bid guarantee shall accompany the bid in the amount of 10% of the bid but not in excess of twenty thousand dollars ($20,000.00) and may be supplied at the option of the bidder, by a Certified Check, Cashier's Check or original Bid Bond from a reputable insurance company authorized to post such bonds in the State of New Jersey. This 10% guaranty is mandatory. 19.If the bid notice to this RFB indicates a consent of surety is required, this bid must be accompanied by an original consent of surety in which the surety company agrees to post a Contract Bond for both (a) Performance and (b) Labor and Material Payment, equal to 100% of the contract amount if the contract is awarded to its principal. Exception: In appropriate circumstances, including the procurement of a vehicle(s) or heavy equipment, an original consent of surety to issue a Performance Bond may be provided in lieu of a consent of surety to provide a Contract Bond. The consent of surety may not contain any conditions or reservations, other than the condition that the contract be awarded to the Contractor, and should be substantially in accordance with the attached sample. The Contract Bond or, if appropriate, the Performance Bond will be required after award and prior to the issuance of an executed Contract and Purchase Order. Separate Performance and Labor and Material Payment Bonds may be submitted in lieu of a Contract Bond, so long as each is for 100% of the contract amount. 20.Bidder, in submitting bid, understands and agrees that the bid security may be forfeited as liquidated damages if the vendor is the successful bidder, receives the award, and thereafter fails to execute the Contract or satisfy other bidding requirements. 21.Unless stated otherwise in this RFB, all bid security checks will be returned to the bidders in compliance with the time frames designated in the Local Public Contracts Law. 1.
