The contract work shall include bids for Aquatic Center Lighting Upgrades Project #1 & Project #2 which include removal of existing pole fixtures, furnishing all materials, and including all costs for an upgrade to LED lights. The City reserves the right to reject any or all Bids, to waive informalities in bidding, and to accept the bid most advantageous to the City. Performance Bond Performance Payment Bond in the full amount of the proposal shall be submitted to the City. The successful Bidder must execute and return the Contract Documents including the Certificate of Insurance and Performance Payment Bond within ten (10) calendar days from the date of the Notice of Award. In the event the successful Bidder fails to execute and return the Contract Documents within the required time, the City may, at its option, consider the Bidder in default and award the Contract to the next lowest responsible Bidder. J. Right to Reject Bid The City reserves the right to reject any or all Bids and to waive any informalities in the bid and to accept the bid that, in the sole judgment of the City, will be in the best interest and/or most advantageous to the City and the citizens to be served by the Agreement. The City reserves the right to reject any bid if the evidence submitted by, or other investigation of the Bidder fails to satisfy the City that the Bidder has the proper qualifications, experience, equipment, manpower, or financial and managerial capability to carry out the obligations of the Contract Documents or to perform the work as required. Work for Project #1 shall be completed by December 31st, 2024. Work for Project #2 is contingent on costs and budget approval but is slated for no later than March 31st, 2025.
