Site work for a water / sewer project in Gibson City, Illinois. Completed plans call for site work for a water / sewer project.

The Project consists of construction: General construction at water treatment facility buildings including: replacement of the existing filtration equipment including filter media, valves, backwash equipment, and instrumentation and controls; General repairs to existing basins, piping and water treatment facility building. Additional construction of a production well, new raw water main and new well house at the location of an existing test well. Question Deadline 12/09/2024 All questions about the meaning or intent of the Bidding Documents are to be submitted to Engineer in writing ILLINOIS EPA CONTRACT AWARD REQUIREMENTS: Any contract or contracts awarded under this invitation for bids are expected to be funded in part by a loan from the Illinois Environmental Protection Agency (Illinois EPA). Neither the State of Illinois nor any of its departments, agencies, or employees is or will be a party to this invitation for bids or any resulting contract. The procurement will be subject to regulations contained in the Procedures for Issuing Loans from the Water Pollution Control Loan Program (35 IAC Part 365), the Davis-Bacon Act (40 USC 276a through 276a-5) as defined by the United States Department of Labor, the Employment of Illinois Workers on Public Works Act (30 ILCS 570), IL Works Jobs Program Act Apprenticeship Initiative, and the "Build America, Buy America Act" requirements as contained in the federal Infrastructure Investment and Jobs Act, Pub. L. No. 117-58. This procurement is also subject to the loan recipient's policy regarding the increased use of Disadvantaged Business Enterprises. The loan recipient's policy requires all bidders to undertake specified affirmative efforts at least sixteen (16) days prior to bid opening. The policy is contained in the specifications. Bidders are also required to comply with the President's Executive Order No. 11246, as amended. The requirements for bidders and contractors under this order are explained in 41 CFR 60-4. BUILD AMERICA, BUY AMERICA (BABA): This project is being partially funded by the State Revolving Fund which requires that all of the iron, steel, manufactured products, and construction materials used for a project are produced in the United States. Project means any activity related to the construction, alteration, maintenance, or repair of a public water system or treatment works in the United States. This law applies to all Federal financial assistance as defined in section 2 CFR 200.1, whether funded through the Infrastructure Investment and Jobs Act (IIJA) or not. New awards made on or after May 14, 2022, must comply with BABA requirements. EPA provides information and guidance on BABA compliance, implementation, and any applicable waivers. Recipients are required to ensure that procurement plans comply with BABA requirements prior to grants being awarded. WAGE RATES: Contractor shall be required to comply with the most recently publicized "Wage of Employees on Public Works (Prevailing Wage) Act" (820 ILCS 130/1 et. Seq. (1993)). Copies of these wage rates are incorporated in the Contract Documents. Not less than the prevailing wage rates on Public Work as established by the U.S. Department of Labor shall be paid. Wages and rates are subject to the provisions of the Davis-Bacon Act (40 USC 276a through 276a-5). FUNDING SOURCE: The project is being funded in part by the Illinois EPA's Water Pollution Control Loan Program (WPCLP), and the Contractor shall comply with all provisions of the rules for that program, under 35 Ill. Adm. Code 365 AWARD OF CONTRACT: Any Contract or Contracts awarded under this Advertisement for Bids are expected to be funded in part by a loan from the Illinois Clean Water Fund. Neither the United States EPA, the Illinois EPA, nor agencies or employees is or will be a party to this Advertisement for Bids or any resulting contract. Any contract(s) awarded under this Advertisement for Bids must demonstrate positive efforts to utilize small, woman owned, and minority owned businesses. Disadvantaged business enterprises are encouraged to submit bids. BID SECURITY: Bid Security in the amount of not less than 5% of the Bid shall accompany each Bid in accordance with the Instructions to Bidders. CONTRACT SECURITY: The Bidder to whom a Contract is awarded shall furnish a Performance Bond and a Payment Bond each in an amount equal to the Contract Price. BID REJECTION/ACCEPTANCE: The Owner reserves the right to reject any and all Bids, waive informalities in bidding, or to accept the Bid or Bids, which best serves the interests of the Owner. BID WITHDRAWAL: No Bid shall be withdrawn for a period of 120 days after the scheduled opening of the bids without the consent of Owner.
