Questions Due Date: Dec 9th 2024, 11:00 AM MST Online Portal Switchboard replacement and minor general/architectural work to partition off electrical switchboard into dedicated electrical room per APS requirements. The Work shall be substantially complete within 462 calendar days after the date when the Contract Times commence to run as provided in the Notice to Proceed, and all Work shall be finally completed and ready for final payment in accordance with the Notice to Proceed within 492 calendar days after the date when the Contract Times commences to run. The City and Contractor recognize that time is of the essence for this Contract and that the City will suffer financial loss, in addition to and apart from the costs described in Paragraph 3.2, if the Work and/or portions of the Work are not performed and completed within the times specified in Section 2, plus any extensions thereof allowed in the Contract Documents. The City and Contractor also recognize the delays, expense, and difficulties involved in proving, through legal or arbitration proceedings, the actual loss suffered by the City if the Work or portion of the Work is not completed on time. Accordingly, instead of requiring any such proof, the City and Contractor agree that the amounts per day set forth herein are reasonable estimates of such liquidated damages for delay (but not as a penalty) and that said amounts do in fact bear a reasonable relationship to the damage that would be sustained by the City, and Contractor agrees to pay such liquidated damages from the Notice to Proceed as herein provided. 3.1.1 Contractor shall pay the City four hundred ninety dollars and zero cents ($490.00) for each calendar day that passes after the time specified for Substantial Completion (462 calendar days from the date of the Notice to Proceed) until the Work is substantially complete. 3.1.2 After Substantial Completion, if Contractor shall neglect, refuse or fail to complete the remaining Work within the Contract Time or any proper extension thereof granted by the City, Contractor shall pay the City two hundred Fifteen dollars and zero cents ($215.00) for each calendar day that passes after the time the Work has been deemed substantially complete which also extends beyond the 30 calendar days specified in Section 2.3, until such time as the Work is finally complete and ready for final payment.
