Earlier this week at the board's Dec. 17 meeting, an error in the bid process gave county commissioners a pause while selecting construction companies for the Coweta County Fire Rescue stations. The county's remaining American Rescue Plan Act funds, which consist of about $5 million and must be obligated by the end of the calendar year or returned to the federal government, will be used for the construction of Fire Station 5. Place Services Inc. submitted a bid for the project of $10,038,511, which was approximately $800,000 less than the next lowest bid. At the Dec. 17 meeting, the commissioners unanimously approved Place Services' bid, however, the next morning, the company submitted a formal withdrawal of its bid. On Friday morning, the commissioners approved J&R Construction and its bid of $10,850,110 to construct the two fire stations. During the meeting, the commissioners advised county staff to make a claim against Place Services' bid bond, which would be about $500,000 or five percent of the construction costs. Commissioner John Reidelbach asked if there was a way for the county to leave a review of the company because the errors in its bid and withdrawal. "I think the bid bond will be a factor out there for the consumption of what's occurred," said County Administrator Michael Fouts. County Attorney Nathan Lee added that if the county seeks to claim the bid bond, it will be noted on the company's attempts to receive bonds in the future. "I recommend you make the claim," he said to the commissioners. "Your staff has real time and effort put into analyzing these bids. They've done a lot of work." The commissioners unanimously approved the new bid and to pursue the bid bond. In a letter to the county, Place Services said its bid was "in good faith and this mistake was due to an inadvertent omission and clerical error." At the Tuesday meeting, the commissioners were already cautious about approving Place Services' bid. County Architect Joe Gardner said he was told in an off-hand remark earlier that day that Place Services did not include the cost of two emergency generators in the bid, which would be an extra $250,000 for both generators. "If the bid was adjusted to reflect that number, they would still be low, but I consider it a qualified bid," Gardner said. "They indicated they had placed a note or something in the bid that excluded the generators. I haven't been able to find the note within the bid package I have here." According to Gardner, he was told that the company will acknowledge in writing that they initially agreed to include the generators in the bid, however, as of Tuesday night, he hadn't received it yet. Chairman John Reidelbach was in favor of approving Place Services' bid because even with the cost of the two generators, as it was still lower than the other bids. He said that the generators would be included in the contract between the county and the company. County Administrator Michael Fouts told the commissioners that if Place Services wasn't willing to sign the contract, then staff would return to the commissioners to approve the next lowest bid. According to Gardner, he spoke to a reference and was told that the firm was good to work with. Fire Chief Robby Flanagan said he reached out to Paulding County Fire Rescue, whom Place Services is currently working for, and the department gave a good review of the firm as well. "So far it's on track and on time and (they) have no complaints with the company," Flanagan told the board. Fouts said the commissioners were on a tight timeline. Bids were due the previous day, and if the board had another meeting before the end of the year, staff would recommend pushing the item to the next agenda, but that wasn't an option. "We have 14 days to get this ARPA allocated," Reidelbach said. "We ain't got a lot of time to play with this. If we accept Place Services, they're going to amend it to add those generators but it still saves us $600,000." On Tuesday night, the commissioners unanimously approved Place Services' bid. The commissioners also: Heard a presentation from students about their involvement in the 4-H Club. Approved Life Scout Hudson Nestlehutt's Eagle Scout project in Whitlock Park. Approved a conditional-use permit for Mt. Gilead United Methodist Church, located at 2202 Bohannon Road, to construct a deck for a baptismal pool. Set a public hearing for Jan. 9, 2025, for amendments to the Appendix A. Article 26, Section 262(F) of the county's code of ordinances. Amended a contract for $2,127.13 for the county's 2024 full depth reclamation project for 14 miles of county roads. Approved an agreement with ThermoFischer Associated to replace the lab equipment in the Coweta County Accountability Courts. Renewed the county's agreement with True Natural Gas. Approved an annual agreement of $16,300 with PSTrax Software for CCFR's inventory management software. Approved a $30,137 agreement with Avigilon Software for security platforms for the county. Submitted a local maintenance improvement grant to the Georgia Department of Transportation to receive $1,839,616.07 in 2025 to rehabilitate 17.2 miles of roads. Approved a Public Transit Agency Safety Plan for Coweta Connect. Raised the minimum pay grade for county employees by 5 percent. Updated the language in the county's solid waste ordinance. Waived the fees at the landfill for the Daughters of the American Revolution to dispose of the wreaths from Wreaths Across America in January. Declared three vehicles from CCFR as surplus. -------------------------- Bids seeking competitive bids from Licensed General Contractors for the construction of Coweta County Fire Stations #5 at a site on Belk Road near the intersection with Smokey Road and Fire Station #10 at a site located on State Hwy. #16 at the intersection of Crook Road, Senoia, Georgia. The Project Architect is Gardner Spencer Smith Tench & Jarbeau, Architects PC, Tower Place, 3340 Peachtree Road, Suite 1800, Atlanta, Georgia 30326 (the "Architect"). The Bidder (e.g., licensed general contractor and/or subcontractors) requiring clarification or interpretation of the Bid documents shall make a written request as prescribed in specification Section 00 3300, Pre-Bid Request for Information which shall reach the Architect by Monday, December 9, 2024 at 5:00 p.m. At the discretion of the County, and in conformity with the applicable provisions of Georgia Law, the County reserves the right to reject any or all Bids, to discontinue any or all negotiations, and to waive any technicalities or informalities. Any Bid submitted in response to this Request shall remain open for acceptance by the County, and same shall be honored by the contractor, for a period of SIXTY (60) days after the actual date of the Bid opening, as set forth hereinabove for the receipt of Bids. All Bids must include a fully executed Bid Bond in the form attached hereto as the AIA Document A310 in the amount of five percent (5%) of the proposed contract stipulated sum (exclusive of any price for Alternates or unit prices). Required Payment and Performance Bonds (AIA Document A312) are required to be submitted by the Bidder in accordance with the requirements of the Contract Documents. Such Payment and Performance Bonds shall each be in the amount of one hundred percent (100%) of the proposed contract stipulated sum as set forth in the Agreement between the County and the Licensed General Contractor . All Bidders must follow the rules of the Illegal Immigration Reform and Enforcement Act of 2011. All Licensed General Contractors and Subcontractors are required to verify new employee work eligibility through a Federal Work Authorization Program and provide evidence of Compliance to the County
