A Cashiers Check, Certified Check, or Bid Bond payable to Meritage Homes of Texas, LLC and Double Eagle Ranch P.I.D. in an amount not less than 5% of the total bid must accompany each Bid as a guarantee that, if awarded the Contract, the bidder will within 10 days of award enter into a Contract and furnish an acceptable Performance and Payment Bond in the amount of 100% of the Contract price. The Bidder's surety will be forfeited and become property of the Owner should the bidder fail to enter into a Contract and furnish bonds acceptable to the Owner within 10 days after award of the Contract. Proposals shall not be withdrawn for a period of 90 days after opening of Bids. The Owner reserves the right to reject any or all Bids and to waive all defects and irregularities in bidding or bidding process except time of submitting a Bid. The Successful Bidder, if any, will be the responsible Bidder who in the Owners judgment will be most advantageous to the Owner and District and result in the best and most economical completion of the Project. A Maintenance Bond will be required in the amount of 10% of the Contract price and is to remain in force for a period of two years from the date of the letter of final acceptance from Bastrop County. Contractor agrees to provide to Corix Utilities Texas a maintenance bond from a surety acceptable to Corix Utilities Texas for all water, wastewater, and lift station facilities, as applicable. The Maintenance Bond shall provide for the repair of any defects in materials, equipment or workmanship for the water, wastewater, and lift station facilities two years from the Completion Date, and shall be in an amount equal to 25% of the total construction costs for the water, wastewater, and lift station facilities. Prevailing Wage Rates, in accordance with Government Code 2258 are applicable to this project.
