The Work of this Contract generally consists of all work associated with constructing a new submersible pump station including all electrical and instrumentation work. The current pump chamber and wet well will be abandoned in place. Each bid shall be accompanied by a bid security in the amount of 5% of the total bid amount and in the form described in the Instructions to Bidders. A Performance Bond and Labor and Materials Payment Bond each in the amount of 100 percent of the contract price will be required in the form described in the Instructions to Bidders. Bidder hereby agrees to commence work under this Contract on or before a date to be specified in the Notice To Proceed and to Substantially Complete the Work within 240 consecutive calendar days thereafter and to complete the Work in full (Final Completion) within 300 consecutive calendar days thereafter. Bidder further agrees to pay as liquidated damages, and not as penalty, the sum of $2,000 per day for each consecutive calendar day of delay in Substantial Completion of the Work and $2,000 per day for each consecutive calendar day of delay in the Final Completion date of the Work beyond the periods listed herein. The Owner reserves the right to reject any or all bids, to accept any bid, to waive any informality on bids received, to omit any item or items deemed advisable for the best interests of the Owner or to limit the extent of the Work to keep within the limits of available funds
