Abatement & Demolition at 417 W. Alondra Prequalification of Prospective Bidders Compton Unified School District ("District") has determined that bidders who submit bids on the above-referenced project must be prequalified. Required Licensure All bidders shall possess the following California contractor's license(s): The District is seeking to prequalify contractors with the following licenses that intend to bid as a general contractor (prime contractor) directly to the District: Class A General Engineering Contractor C21 - Building Moving/Demolition Contractor Completion of Prequalification Application A Prequalification Application will be required for all Prequalified contractors through online. All prospective pre-qualified contractors are required to fully and completely respond to the materials in the Prequalification Application. The Prequalification Application will be emailed to each prospective pre-qualified contractor. Any interested pre-qualified contractor who does not submit the required information using the Prequalification Application and/or any attempt to use an alternative form by an interested pre-qualified contractor shall be disregarded by the District. All blanks and requested information in the Prequalification Application must be appropriately filled in and all required documents and attachments must be provided. The District reserves the right to reject any Prequalification Application if all of the information is not furnished by the bidder. It is each bidder s sole responsibility to ensure its Prequalification Application is fully and completely filled out, timely delivered and received at the location designated in the Prequalification Application. Any Prequalification Application received after the scheduled time for receipt shall be rejected. All Prequalification Applications shall be completed by the date and time set forth above. Any interested party is solely responsible for ensuring its prequalification application is completed by the deadline set forth above and is fully complete and responsive. The District shall not be responsible for any delays or errors in submission. All interested parties must take all steps necessary to ensure their Prequalification Application is completed in a timely manner through online. Prequalification to bid on the project listed is required irrespective of, and in addition to, any prequalification for any other District work already on file. The District reserves the right to reject any or all responses to the Prequalification Application and to waive any non-material irregularities in any response received. Upon completing its review of the Prequalification Applications and making its determination of the pre-qualified bidders, the bidders who were determined to be pre-qualified and those who were not pre-qualified will be notified via online. The Prequalification Application requires that the bidder submit its six (6) most recently completed public works projects and its three largest completed private projects within the last five (5) years. PLEASE NOTE: For the six (6) public works projects, the District requires that three (3) of the six (6) public works projects be a K-14 public school / community college project with a contract value at or above $500,000.00. It is highly recommended that your company submit the strongest, highest dollar amount K-14 projects to online in order to qualify for future projects as well. Bidders will make efforts to contact and receive responses from the bidder's references within five (5) business days of the bidder submitting the Prequalification Application. To the extent the identified references fail to respond within this five (5) day period, the District has the right to determine that the references identified by the bidder are not responsive, do not constitute a passing score, and constitute grounds for denial of pre-qualification to the bidder. Prior Submission of Prequalification Application To the extent bidder previously submitted a Prequalification Application with online as part of the prequalification procedures within the last 12 months, there is no need for bidder to resubmit a new Prequalification Application, as the prequalification remains in place for 12 months. If the bidder s qualifications identified in the prior submission of the Prequalification Application satisfy the requirements for this Project, then bidder will be considered to be prequalified. If the bidder s qualifications identified in the prior submission of the Prequalification Application do not satisfy the requirements for this Project, then the bidder will be considered not to be prequalified. Brief Description of the Project: Project includes, but is not limited to, the following: This project generally consists of abatement of hazardous materials, building demolition, selective demolition and the salvaging of miscellaneous materials and equipment to be determined by the District. This project does not include any new construction or modernization. Labor Compliance Requirements All contractors must comply with the all applicable labor compliance requirements under the California Labor Code, including but not limited to, registration with the Department of Industrial Relations (Labor Code Sections 1771.1(a) and 1725.5), 1771, 1771.4, 1773.2, 1774, 1776, 1777.5, 1813, and 1815. All contractors must also comply with the Project Labor Agreement (PLA) Compton USD Measure S Community Benefits Agreement (CBA) 2019 . SB 854 Department of Industrial Relations SB 854 (Stat. 2014, chapter 28) made several changes to the laws governing how the Department of Industrial Relations (DIR) monitors compliance with prevailing wage requirements on public works projects. Prevailing wage applies to project over $1,000.00. Pursuant to California Labor Code Section 1771.1(a), as amended by SB 854, a contractor may not bid, nor be listed as a subcontractor, for any bid proposal submitted for public work or engage in the performance of any contract for public work unless registered and qualified to perform public work pursuant to Labor Code Section 1725.5, subject to limited legal exceptions. Section 1771.1(a) states as follows: "A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5 It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business & Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded." As a result, no contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with DIR. To comply with the DIR guidelines, the District will disqualify any contractor (and subcontractor) who is not registered with the DIR at the time the bid (or prequalification) package is opened, the award will go to the next low responsible bidder who is registered with the DIR. All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement). This project will be subject to compliance monitoring and enforcement by the DIR, pursuant to California Labor Code Section 1771.4. In addition to submitting certified payroll records directly to the Labor Commissioner, the awarded contractor must also provide one original set of certified payroll records to the District s Purchasing Department. Appeal Procedures A Contractor may appeal the District s decision. If a Contractor decides to appeal the District s prequalification decision, it must follow the following procedure: 1. Contractor shall submit, in writing, within five (5) working days from District s determination, a request for a written response from the District to explain the District s determination. 2. Within five (5) working days from receipt of the District s written response to the Contractor s request, Contractor may submit, in writing, a request for a meeting with the District s staff. Contractor may submit with the request any and all information that it believes supports a finding that District s determination should be changed. 3. District staff shall hold a meeting with the Contractor. If the Contractor continues to contest the District s determination after that meeting with District staff, then the Contractor may address the Board at the next public noticed meeting of the District s governing board, pursuant to the governing board s procedures for public comment. To Preserve the Contractor S Right to Challenge the District S Determination, the Contractor Shall Address the Board at the Next Public Noticed Meeting of the Board After Contractor S Meeting With District Staff. 4. Failure of a Contractor to Timely Follow All Appeal Steps Shall Be a Waiver of the Contractor S Right to Appeal the District S Decision.
