Such bids are to provide for purchase of Fiber Access Equipment for the Brookings Municipal Utilities d.b.a. Swiftel Communications. Each proposal must be accompanied by a certified check, cashiers check or draft, for five percent (5%) of the amount of the bid, such check to be certified or issued by either a State or National Bank, and payable to the Brookings Municipal Utilities, South Dakota, or in lieu thereof, a bid bond for ten percent (10%) of the amount of the bid, such bond to be issued by the surety authorized to do business in the state of South Dakota and payable to Brookings Municipal Utilities. Note that the bid security must be sufficient to cover the base bid "Pricing Proposal" total. The check or bond will be retained by Brookings Municipal Utilities as liquidated damages if the successful bidder refuses or fails to enter into a contract in accordance with the bid within 10 working days after written notification of the award of the bid. Bids may not be withdrawn within thirty days after the actual opening thereof. Brookings Municipal Utilities reserves the right to waive minor irregularities and/or to reject any and all bids. By virtue of statutory authority, preference will be given materials, products, and supplies found or produced within the state of South Dakota.
