Services under this new procurement will be to remove and dispose of hazardous and other special wastes from Metro facilities. These services are required to comply with federal, state and local environmental regulations. GENERAL The Contractor shall provide services for the removal and disposal of hazardous waste (including radioactive materials, medical or bio wastes, emissions, and/or discharges released in any manner), hazardous substances, and/or special wastes on an as-needed/if needed basis. The Contractor shall provide services for the transportation, handling and disposal of hazardous materials on an as-needed / if needed basis. The Contractor's services may be used for the cleanup of uncontrolled hazardous waste and uncontrolled solid waste sites. The contractor may also be asked to respond to the cleanup of hazardous materials and/or hazardous waste spills in the greater Washington, DC area. The Contractor shall agree that hazardous materials, substances, and/or wastes may be: 1. As uncollected material on or under the surface of the ground; 2. 3. In or on a water body; or In containers. The Contractor shall provide drums or other containers when requested or required. Material and waste handling, including transferring product, placement into containers or over-packs, and disposal of used containers is included in this Scope of Work. The Contractor shall ensure that all appropriate shipping labels and placards are in place prior to transporting materials and/or wastes. The Contractor's employees who are pre-qualified and certified to perform work under this contract shall obtain authorized WMATA Contractor badges (with photo ID) at least annually. It is the responsibility of the Contractor to ensure that all contractor employee badges are kept valid and up to date throughout the contract performance period. The Contractor shall ensure an adequate number of employees are properly badged to service this contract. H. I. J. K. . L. M. 2.2 A. B. C. D. The Contractor's employees designated to obtain WMATA Contractor badges shall attend WMATA's Contractor Roadway Worker Protection (C-RWP) training at least annually. WMATA may request to visit any of the Contractor's collection facilities during the evaluation and/or contract performance period. At all times, the Contractor's employees shall wear personal protective equipment (PPE) appropriate to services rendered. At a minimum, Level D PPE includes work boots, work gloves, chemical gloves, eye protection, hearing protection, and hard hats appropriate to work. Additionally, each employee shall wear a safety vest that meets WMATA's requirements for its Contractors. The Contractor, its facility(ies), personnel, equipment, and its commercial vehicles (including rentals and leased vehicles) must maintain all up-to-date certifications, licenses and permits required to handle, clean up, transport, and dispose of all hazardous materials and all hazardous wastes that are included in this Scope of Work. These licenses and certifications includethe following. 1. 2. 3. Employees must maintain current certificates for HAZWOPER. Drivers must possess CDL with hazmat endorsements. Trucks must maintain applicable permits. The Contractor, its facilities, personnel, equipment, procedures, and its commercial vehicles must be in compliance with all current and future Federal, State and Local requirements including, but not limited to, the following: 1. 2. 3. 40 CFR Parts 260 - 279 49 CFR Parts 100-185 and 300-399 29 CFR Part 1910.120 No hazardous waste as defined by the Resource Conservation and Recovery Act 42 U.S.C. Sec. 6901 et. seq. and regulations thereunder, shall be stored, treated, disposed of, or otherwise managed, at any facility unless it is an approved EPA facility and possesses a current and valid EPA permit/registration number.
