All bids must be accompanied by bid security equal to five percent (5%) of the sum of the base bid and all alternates and must be in the form of a certified check, cashier's check or bid bond, as outlined in the Instructions to Bidders. The Successful Bidder will be required to furnish a performance and payment bond, each in an amount equal to 100% of the contract amount. The bidder will commence work under this contract and be Substantially Complete within 120 consecutive calendar days The bidder shall agree to pay as liquidated damages the amount of five hundred dollars ($500.00) for each consecutive calendar day for which the work is not complete, beginning with the first day beyond the completion date stated on the "notice to proceed". Said sum shall in no event be construed to be a penalty; but only as damages fixed and agreed upon in advance. Some scope items required for substantial completion must fall in sequence after completion of General Contractor's scope of work for Pelican Park Skatepark & Pump Track - Sitework Scope, coordination will be required Substantially Complete shall be defined as having the following open for public use: o All concrete, shotcrete, steel and other rideable elements of the skatepark and pump track and alternate #1 (if accepted) Contractor shall commence work under this contract and have the project Fully Complete and ready for final acceptance within 140 consecutive calendar days.
