The project includes construction of a berm along the southwest property boundary of Phase VI of Cherry Island Landfill to bifurcate the Wilmington Harbor North dredged material management area. The work includes, but is not limited to, surveying before, during, and after construction; clearing, grubbing and grading; installing geotechnical instrumentation; installing prefabricated vertical drains; constructing the bifurcation berm; and constructing stormwater conveyance features. Additional information and details regarding the scope of work are included in the Project Manual. Each Bid, in excess of $200,000, shall be accompanied by a certified check or surety company bid bond, drawn to the order of the Delaware Solid Waste Authority on the form provided in the Project Manual and in an amount not less than ten percent (10%) of the "total bid price" as a guarantee that if the Bid is accepted, a contract will be entered into and the performance thereby properly secured. Question Deadline 02/14/2025 at 2:00 PM ET The successful Bidder will be required to execute the Agreement, to furnish a performance bond and payment bond for the work each in the amount of one hundred percent (100%) of the "Total Bid Price" if the bid amount is more than $200,000, and to execute a Hold Harmless Agreement on forms provided in the Project Manual. The successful bidder will also be required to furnish evidence of insurance coverage as required by the Project Manual and otherwise comply with terms and requirements of the Project Manual. DSWA reserves the right to accept or reject any or all Bids which in its judgment is in the best interest of DSWA, and to waive any irregularities or informalities in the Bid or Bid process, and all BIDDERS are notified that such acceptance or rejection or waiver shall be without liability on the part of DSWA for any action brought against DSWA, any or all of its directors, or any DSWA agent, officer or employee, brought by any BIDDER because of such acceptance or rejection or waiver, nor shall any Bidder seek any recourse of any kind against such entity or individuals because of such acceptance or rejection or waiver. Every BID prepared in response to this notice shall be prepared at the sole cost and expense of the BIDDER and shall be prepared by the BIDDER with the express understanding that any and all claims to reimbursement for the cost and expense of its preparation are waived. The submittal of a bid in response to this notice shall constitute an agreement of the Bidder to all the provisions set forth in this notice and the Project Manual.
