The owner has the right to reject any and all bids. The owner may also waive any informality or technicality. Bidders are required to execute a non-collusive bidding affidavit pursuant to Section 103d of the General Municipal Law of the State of New York. Failure to provide an executed non-collusive bidding affidavit will invalidate a bidder's bid. Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and the minimum wage rates to be paid per Segregated Facilities, Section 109, and Executive Order 11246. Bidders are also required to comply with the provisions of Section 291-299 of the Executive Law of the State of New York. No bidder may withdraw his/her bid during the forty-five (45) days after the actual date of the opening thereof. Subject to the provisions of Article 28, Part III of the New York State Tax Law and the provisions of the Contract Documents, the Owner is exempt from payment of sales and compensating use taxes of the State of New York and cities and counties on all materials supplied to the Owner pursuant to this contract. The City of Port Jervis hereby notifies all bidders that it will affirmatively insure that in regard to any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or natural origin in consideration of an award. Note that firms certified as Minority Business Enterprises (MBE) and Women Business Enterprises (WBE), and/or Service-Disabled Veteran-Owned Business Enterprises (SDVOB) are strongly encouraged to participate. The City has acquired a grant under the Resilient Investments through Support and Capital (RISC) program from the Housing Trust Fund Corporation, represented by the New York State (NYS) Homes and Community Renewal (HCR) Office of Resilient Homes and Communities (ORHC), that is funded by a United States Department of Housing and Urban Development Community (HUD) Development Block Grant Disaster Recovery (CDBG-DR) allocation to NYS to support long-term recovery efforts in response to Hurricane Ida (FEMA DR-4615). The work undertaken will be in accordance with the standard requirements and conditions described in Exhibit A: IDA Subrecipient Agreement (SRA) to this RFP that are applicable to contractors and subcontractors. This includes but is not limited to Sections "10(B) Subcontracting" and the MBE, WBE, SDVOB and other participation goals and reporting requirements outlined in Appendix 1 to the SRA. Interested parties shall submit with their proposal a Vendor Responsibility Questionnaire (VRQ) which is accessible through the Office of the New York State Comptroller via the VendRep system available online at website. Reservoir 1 is a spillway from the City's water plant that travels into and through the surrounding residential neighborhood located in the City of Port Jervis in Orange County, NY. It is located at the base of the mountains surrounding Port Jervis where water runoff joins reservoir runoff and often causes flooding in local streets, homes, and businesses. Due to eroding, the reservoir spillway is also collapsing into itself thereby reducing water flow and threatening extreme overflow in heavy rains. In addition, a 24" watermain runs along and under the spillway and feeds water to the entire city. The City fears that reoccurring flooding will cause the failure of the spillway and the water main which will lead to flooding the neighborhood and when out of service will stop water service to the entire city of approximately 8,500 residents. The Reservoir 1 Spillway Rehab and Water Main Resiliency Planning Project will complete a comprehensive drainage analysis of the project area and develop a conceptual design that addresses the flooding and protection of the watermain. The study will explore if rebuilding the spillway and replacing the critical 24" water main may provide flood relief. In addition, a cost benefit analysis will need to be completed for use in applications to capital funding sources for construction implementation along with grant application submission support.
