The District designated Professional Engineer Jennifer Malloy and Apex Engineering as the Districts engineer for the proposed Project, and pursuant to their appointment, Engineer Malloy and Apex Engineering prepared and filed an engineers report showing the profiles, plans, and specifications for the proposed Project (Engineers Report), a map of the lands to be drained by the proposed Project, and an estimate of the total cost of the proposed Project and filed the same with the District; and WHEREAS , the District approved the starting point, general course, and terminus of the proposed Project more specifically described as follows: The starting point of the proposed Project main channel construction shall be at the existing drain/watercourse located near boundary between the Northwest Quarter of the Northwest Quarter (Lot 4) and the Southwest Quarter of the Northwest Quarter of Section 2, Township 160 North, Range 79 West (Tacoma Township), then continuing northeasterly across the Northwest Quarter of the Northwest Quarter (Lot 4), then easterly into the Northeast Quarter of the Northwest Quarter (Lot 3) of said Section 2, until terminating just east of the west boundary of said Northeast Quarter of the Northwest Quarter (Lot 3) of said Section 2, Township 160 North, Range 79 West (Tacoma Township), all in Bottineau County, North Dakota. There shall be a side channel to the main channel of the proposed Project, the starting point of which is approximately three hundred and thirty feet (330) southeasterly of the main channel and is located in the Southwest Quarter of the Northwest Quarter of Section 2, Township 160 North, Range 79 West (Tacoma Township), then draining northwesterly across said Southwest Quarter of the Northwest Quarter until it confluences with the main channel just north of the north boundary line of said Southwest Quarter of the Northwest Quarter of said Section 2, Township 160 North, Range 79 West (Tacoma Township), all in Bottineau County, North Dakota; and WHEREAS, the District determined, by inspection by and through Engineer Malloy and Apex Engineering, the particular lots and parcels of land which, in the opinion of the District, would be especially benefited by the construction of the proposed Project, certifying the same through a proposed assessment list that shows the percentage assessment against each parcel of land benefited by the proposed Project and the approximate assessment in terms of money apportioned thereto; and WHEREAS , the District found that the total cost of acquiring rights-of-way and constructing the proposed Project apportioned to each benefited lot and parcel in the proposed assessment list is not exceeded by the benefits to each lot and parcel; and WHEREAS ,
