A Proposal shall be accompanied by a certified check payable to the Metropolitan Utilities District of Omaha in the amount of ten percent (10%) of the base bid, including unit price totals, drawn on a Federal Reserve System member bank, or by a bid bond in a like amount on the form supplied by the District and executed by a surety authorized to engage in the surety business in the State of Nebraska (Bid Security). The Bidder agrees that if the main has not been placed into service within 90 calendar days after Notice to Proceed that they shall be liable therefore and does hereby agree liquidated damages for such breach of Contract, the sum of $0.00 for each and every calendar day that the Contractor shall be in default.
