FY 24/25 CDBG Ada Ramp Replacements In general, the work is comprised of public works construction including but not limited to the removal/disposal of existing concrete ADA curb ramps and re-construction of new concrete ADA curb ramps including other miscellaneous improvements as described in the Specifications, and as required to complete the work. No bid will be considered unless it is made on a Proposal form furnished by the City. No Bidder may withdraw its Proposal for a period of ninety (90) days after the time set for opening thereof. Each bid must be accompanied by cash, a certified cashier's check, or a bidder's bond made payable to the City of Lakewood for an amount equal to at least ten percent (10%) of the amount bid, such guarantee to be forfeited should the bidder to whom the contract is awarded fail to furnish the required bonds and insurance and enter into a contract with the City within the period of time provided by the proposal requirements. In the event that a surety bond is submitted in lieu of the foregoing, it shall be subject to the condition that the surety thereon and the form of the bond be approved by the City Attorney. All bids and bidder s security shall be placed within a sealed cover, with the cover bearing the title of work and name of bidder, and shall be filed with the City Clerk, located at Lakewood City Hall, 5050 Clark Avenue, Lakewood, California, on or before the time hereinbefore set forth for the opening of bids. Any bid received after said time shall be returned unopened. At the time fixed for receiving bids, the bids will be publicly opened, examined and declared. The bids will be checked and the results will be reported to the City Council at a future meeting in the City Council Chambers of the City of Lakewood, 5000 Clark Avenue, Lakewood, California. The City reserves the right to reject any or all bids and to waive minor irregularities or informalities in any bonds or in the contract proposal. The City reserves the right after opening bids to reject any or all bids, to waive any informality in a bid, or to make award to the lowest responsive, responsible Bidder as determined by the Proposal, and reject all other bids, as it may best serve the interest of the City. Within three (3) days of bid opening, the apparent low Bidder must submit a revised bid bond with numerical dollar values, both in words and with digits of the Bid Bond amount. Within ten (10) working days after the date of the formal Notice of Apparent Low Bidder, the successful Bidder will be required to submit the fully executed Contract Agreement, Bonds (Faithful Performance and Payment (Material and Labor)) and Insurance, all meeting the standards of the City. The Contractor shall possess a valid Class A (General Engineering Contractor) as necessary to perform the work, at the time of contract award, in accordance with provisions of Chapter 9, Division III of the California Business and Professions Code. The Contractor must be properly licensed as a contractor from contract award through Contract acceptance (23CFR 635.110). The wage rates applicable to this Project are the State of California Department of Industrial Relations prevailing rates of per diem wages and/or Davis-Bacon Federal Wage Rates, whichever are higher. In accordance with the provisions of Sections 1773.2 of the California Labor Code, copies of the general prevailing rate of per diem wages as determined by the State Director of Industrial Relations are available online. The Davis-Bacon Federal Wage Rates are available online. It shall be mandatory upon the Contractor to whom the contract is awarded and upon any subcontractor to pay not less than said specified rates to all workers employed by them in the execution of the contract. A copy of said rates shall be posted at each job site during the course of construction. The Contractor and all subcontractors shall comply with all provisions of the California Labor Code relating to prevailing wage rates, including Sections 1770 1781. This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. The Department of Industrial Relations shall monitor and enforce compliance with applicable prevailing wage requirements for the contract. The reporting requirements may be found at online. The Contractor is responsible for complying with all requirements of the Department of Industrial Relations, including filing electronic payroll reports. A contractor or subcontractor will not be qualified to bid on, be listed in a bid Proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5. It is not a violation of Labor Code Section 1771.1 for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. Attention is directed to Sections 1777.5, 1777.6, and 1777.7 of the California Labor Code and Title 8 of the California Administrative Code, Section 200, et seq. , to ensure compliance and complete understanding of the law regarding apprentices. CONFLICT OF INTEREST: in the procurement of supplies, equipment, construction, and services by sub-recipients, the conflict-of-interest provisions in 24 CFR 85.36, OMB Circular A-110, and 24 CFR 570.611 shall apply. No employee, officer, or agent of the sub-recipient shall participate in the selection, award, or administration of a contract supported by federal funds if a conflict of interest, real or apparent, would be involved. BUY AMERICA: Buy America Requirements apply to steel and iron, manufactured products, and construction materials permanently incorporated into the project. FEDERAL CONTRACT PROVISIONS. This Project utilizes Community Development Block Grant (CDBG) Federal funds. Contractor shall perform the Work in accordance with the federal contract provisions contained in the Public Works Contract - Required Federal Contract Provisions.
