University is seeking a qualified vendor to replace roofs on buildings 4 & 12 at Chaparral Village. Works is to also includes replacement of deck sheathing underlayment related to the roof replacement. The undersigned agrees that, from the compensation otherwise to be paid, the Owner may retain the sum of $500.00 for each calendar day after the Substantial Completion Date that the work remains incomplete, which sum is agreed upon as the proper measure of liquidated damages which the Owner will sustain per diem by the failure of the Undersigned to complete the work at the time stipulated in the Contract. This sum is not construed in any sense as a penalty. The undersigned agrees to execute the Payment and Performance Bonds within ten (10) calendar days after award, in the amount of one hundred percent (100%) of the contract price, after notification that the offeror has been identified by the Owner as the Respondent with the "best value" Proposal. The bonds shall be in the full contract amount. The University intends to engage with the awarded General Contractor at earliest possible timeframe to achieve the desired completion date. If responding to the project Alternate, UTSA has approved and identified a construction period of December 15th, 2025 thru January 14th, 2026. It is understood that the Owner reserves the right to accept or reject any and all Proposals and to waive proposal irregularities. It is further agreed that this Bid shall be valid and not withdrawn for a period of sixty (60) days from the date of opening thereof.
