Potential Bidders May Contact Ackerman-estvold at (701) 577-4127 With Any Questions. The project consists of the following approximate principal quantities; 424,000 cy common excavation-type b; 36,000 cy common excavation-waste; 153,000 ton stabilized aggregate base course; 91,000 ton of super pave FAA 43; 5,100 ton PG 58h-28 asphalt cement; 2,700 IF CMP (18in-36in) culverts and end sections; 3,500 IF RCP cl iii (18in72in) culverts and end sections; traffic control; pavement marking; seeding and hydro mulch; and all miscellaneous work necessary to complete the project. All bids are to be submitted on the basis of cash payment for the work and materials necessary to complete the project. Each bid must be accompanied by a separate envelope containing the contractor's license and bid security. The Bid Security Must Be in a Sum Equal to Five Percent of the Full Amount of the Bid and Must Be in the Form of a Bidder's Bond. A Bidder's Bond Must Be Executed by the Bidder as Principal and by a Surety, Conditioned That if the Principal's Bid is Accepted and the Contract Awarded to the Principal, the Principal, Within Ten Days After Notice of the Award, Shall Execute a Contract in Accordance With the Terms of the Bid and the Bid Bond and Any Condition of the Governing Body. A Countersignature of a Bid Bond is Not Required Under This Section. If a Successful Bidder Does Not Execute a Contract Within the Ten Days Allowed, the Bidder's Bond Must Be Forfeited to the Owner and the Project Awarded to the Next Lowest Responsible Bidder. Bidders Must Be Licensed for the Full Amount of the Bid as Required by Section 43-07-12 of the North Dakota Century Code. No Bid May Be Read or Considered if It Does Not Fully Comply With the Requirements of Section 48-01.2-05 of the North Dakota Century Code. Any Deficient Bid Received Will Be Resealed and Returned to the Bidder Immediately. The Owner Reserves the Right to Hold All Bids for 45 Days, to Reject Any or All Bids, to Waive Any Informality or Irregularity in Any Bid, to Accept the Bid Deemed in the Best Interest of the Owner, and to Rebid the Project Until a Satisfactory Bid is Received. There Shall Be Endorsed Upon the Outside of the Envelope Containing the Bid, the Following: 1. "Williams County Road 11a & 42 Reconstruction" 2. The Date of the Proposal 3. The Name of the Person, Firm, Corporation, or Joint Venture Submitting the Bid. 4. The Bidder's Contractor's License or Contractor's License Renewal Number. 5. Acknowledgement of the Addenda, if Any. All Work Shall Be Substantially Complete by October 4, 2025. All Work Shall Be Completed and Ready for Final Payment in Accordance With the General Conditions by October 18, 2025. Should the Contractor Fail to Complete Its Obligations Under the Contract Within the Time Required Herein or Within Such Extra Time as May Have Been Granted by Formal Extensions of Time Approved by the Owner, There Will Be Deducted From Any Amount Due to the Contractor the Sum of $5,000 Per Day for Each and Every Calendar Day That the Completion of the Work is Delayed. The Contractor and His Surety Will Be Liable for Any Excess. Such Payment Will Be as and for Liquidated Damages and Not as a Penalty.
