B. BONDING Instructions: Proposers must submit, with their proposal, a proposal security (bid bond) in the amount of five percent (5%) of the maximum amount proposed, payable without recourse to DENTON COUNTY, TEXAS, as a guarantee that the Proposer will enter into a contract and execute bond and guarantee forms provided within then (10) days after the award of contract to their company. The original Bid Bond must be received in the office of the Director of Purchasing for Denton County, located at 1 Courthouse Drive, Suite 2300, Denton, TX 76208, no later than the Proposal due date and time, for the submission to be considered responsive. 1. The successful Proposer must furnish Payment and Performance Bonds each in the amount of one hundred percent (100%) of the contract price from an approved Surety Company. (An approved Surety Company being a company holding a permit from the State of Texas, to act as Surety, and being acceptable according to the latest list of companies holding certificates of approval from the State Board of Insurance under 7.19-1 of the Texas Insurance Code.) The successful Proposer must also be able to show evidence that it is authorized to do business in the State of Texas prior to executing the contract. Bid bond and policies of insurance shall be approved by the Owner before a successful proposer may proceed with the work.
