Neither Owner nor Engineer will be responsible for full or partial sets of the Contract Documents, including Addenda if any, obtained from sources other than the issuing office. All bidders must obtain a set of the Contract Documents. Each Bid must be accompanied by a certified or bank cashier's check made payable to OWNER, or a Bid Bond issued by a surety licensed to conduct business in the state where the Project is located and having a Best Rating of A- or better from A.M. Best Company and named in the current list of "Companies Holding Certificates of Authority as Sureties on Federal Bonds and as Acceptable Reinsuring Companies" as published in Circular 570 (amended) by the Financial Management Service, Surety Bond Branch, U.S. Department of the Treasury, in an amount not less than five percent of the amount of the Bid submitted. The list may be ordered from the Government Printing Office Bookstore, 26 Federal Plaza, Room 110, New York, NY 10278, (212) 264-3825. Each Bidder must complete and submit with their bid the "Iranian Investment Activities Certification" provided in the Bid Form in compliance with General Municipal Law 103-g, Iranian Energy Sector Divestment. Each Bidder must complete and submit with their Bid the "Certification of Compliance with New York State Labor Law Section Two Hundred One-G" provided in the Bid Form regarding the implementation of a written policy addressing sexual harassment prevention in the workplace. The Bidder to whom the OWNER proposes to award the Contract will be required to furnish performance and payment bonds and the necessary insurance certificates as prescribed in the General Conditions and the Supplementary Conditions upon the execution of the Agreement within ten (10) days of the Notice of Award. Bidders are required to execute a non-collusive bidding certification required by Section 103- d of the General Municipal Law of the State of New York. This project is being funded in whole or in part by the Community Development Block Grant Program (CDBG) CFDA 14.218 with funds obtained from the U.S. Department of Housing and Urban Development (HUD). All bids must meet the requirements of the General Municipal Law of the State of New York and all other applicable federal, state and local statutes. All federal CDBG requirements will apply to the contract. Strict compliance with all Federal Labor Standards is mandatory. Prevailing wages established under the Davis-Bacon Act will apply to this contract. New York State law requires that the contractor pay the higher of New York State prevailing wages or Davis-Bacon, for each class of worker. The awarded contract will contain requirements addressing prevailing labor wage rates, labor standards, nondiscrimination in hiring practices, MBE and WBE outreach and participation, and 2 CFR Part 200. See Instructions to Bidders for additional information. Attention of bidders is particularly called to the requirement as to conditions of employment to be observed and the minimum wage rates to be paid under the Contract, Segregated Facilities, Section 109, and Executive Order 11246. The requirements for Bidders and Contractors under this order, which concerns non-discrimination in employment, are further explained in the Contract Documents and Attachments. Bidders are also required to comply with the provisions of Section 291- 299 of the Executive Law of the State of New York. The Town of Blooming Grove, an equal opportunity employer and affirmative action employer, hereby notifies all bidders that it will affirmatively ensure that in regard to any contract entered into pursuant to this advertisement, women and minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the ground of race, gender, color or national origin in consideration of an award. The Bidders/offerors must submit documentary evidence of minority and women business enterprises who have been outreached to and/or contracted with and to whom commitments shall be submitted concurrently with the bid. The lowest qualified bidder meeting the requirements of the Contract Documents will be awarded the bid. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, 12 U.S.C. 1701 U (section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance shall to the greatest extent feasible, be directed to low-and very low-income persons. Section 3 Businesses are encouraged to submit bid proposals. The contract documents contain requirements addressing prevailing labor wage rates, labor standards, nondiscrimination in hiring practices, goals for minority and female participation, MWBE participation, and, for projects over $200,000, participation by Section 3 residents and businesses, related matters. Provisions under 2 CFR Part 200 will apply to the awarded contract. Bidders must submit documentary evidence of minority and women business enterprises, as well as Section 3 businesses and residents if applicable, who have been contracted and to whom commitments shall be submitted concurrently with the bid. Bidders are also required to comply with the anti-discrimination provisions of Sections 290- 301 of the Executive Law of the State of New York. The OWNER reserves the right to reject any or all of the Bids received, to readvertise for Bids, to abandon the project, to waive any or all informalities in any Bid received and to accept any proposal which the OWNER decides to be for the best interest of the OWNER. There shall be no formal pre-bid conference. All questions must be submitted, in writing, to Christine Bodeker no later than 4:00 p.m. on Wednesday, March 6, 2025. Questions must be sent via email to supervisorsclerk@bloominggrove-ny.gov. The project may be funded through a Community Development Block Grant. As such the work under this contract is subject to Davis Bacon Wages, Section 3 Requirements and MBE/WBE participation of at least 25% Section 3 Labor Hours and 5% Targeted Section 3 Workers (within the 25% goal), 15% MBE and 15% WBE, respectively.
