Hard copy sets may be mailed to the bidder ONLY if the bidder provides a FedEx or UPS account number to the sender, WDB Engineering, PLLC. Refunds will not be made. Each bidder shall accompany his original bid, with a certified or Cashier's Check on a solvent bank located in Oklahoma or a Bidder's Bond, in the amount of five (5) percent of the amount bid, as a guarantee of his ability to perform the contract bid upon, and that he will enter into a written contract with the Owner to perform said work and/or furnish said materials in accordance with said plans and specifications and furnish the required bonds within ten (10) days after the acceptance of his bid. The deposit will be retained by the Owner as, and for, liquidated damages in case the successful bidder fails to enter in said contract and furnish the required bonds provided for in the specifications within the time required. Deposit of the unsuccessful bidders will be returned upon the execution of the Contract and required bonds. Each bidder shall accompany his bid with a DW- 412 Noncollusion Affidavit and a DW-413 Business Relationships Affidavit in writing displaying that the Bidder has not directly or indirectly entered into an agreement, express of implied, with any other bidder or the price or amount of such bid or any bids, the limiting of the bids or bidders, the paying to anyone any money for promotion expenses, the parceling or farming out to any bidder or bidders or other persons of any part of the contract or any part of the subject matter of the bid or of the profits thereof. Performance, Maintenance and Statutory Payment Bonds in the amount of 100% of the contract price with a Corporate Surety licensed in Oklahoma and approved by the Owner and Engineer, will be required for the faithful performance of the contract. A Maintenance Bond guaranteeing the repair of all damage due to improper materials or workmanship for a period of one (1) year, after the acceptance of the work by the Owner, will be required. This project is to be financed by a loan from the Oklahoma Water Resources Board through the Department of Environmental Quality Drinking Water State Revolving Fund (DWSRF) and shall be referred to as DWSRF Project No. P40-2002444-01. Each bidder must fully comply with the requirements, terms and conditions of the Department of Environmental Quality (DEQ) Small, Minority, Women's Businesses Requirements including affirmative steps to contract with small, minority and women's businesses during the performance of this contract. The bidder commits itself to the affirmative steps to contract with small, minority and women's businesses contained herein and all other requirements, terms and conditions of these bid conditions by submitting a properly signed bid. Requirements are contained in Department of Environmental Quality Guidance and Procedures, DW-700." All bidders must comply with the Anti-Kickback Act and the Contract Work Hours Standards Act." D. "Davis Bacon Act wage rules shall apply. All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. "American Iron and Steel provisions also apply to projects funded directly by or assisted in whole or in part by and through the Federal Government pursuant to the "Consolidated Appropriations Act, 2014". Sec. 436(a)(1) of the act states that "None of the funds made available by a State Water Pollution Control Revolving Fund as authorized by title VI of the Federal Water Pollution Control Act (33 U.S.C 1381 et seq.) or made available by a Drinking Water Treatment Revolving Loan Fund as authorized by Section 1452 of the Safe Drinking Water Act (42 U.S.C. 300j-12) shall be used for a project for the construction, alteration, maintenance, or repair of a public water system or treatment works unless all of the iron and steel products used in the project are produced in the United States." System for Award Management registration is required for all DWSRF program applicants and Awardees (Entities, prime contractors, subcontractors, vendors) in order to be awarded contracts by the DWSRF program replaces Central Contractor Registration/Federal Agency Registration, Online Representations and Certifications Application, and Excluded Parties List System. Applicants and awardees are required to complete a one-time free registration to provide basic information relevant to procurement and financial transactions. DUNS number is a unique, non-indicative 9-digit identifier issued and maintained by Dun & Bradstreet (D&B) that verifies the existence of a business entity globally. D&B assigns DUNS numbers for each physical location of a business. Bids received more than ninety-six (96) hours prior to the Bid Opening will be returned. The contract is to be awarded to the lowest responsive, responsible bidder. The Owner reserves the right to waive any informalities in the bidding and the right to reject any and all bids in accordance with the Oklahoma Competitive Bidding Act. Conditional bids shall not be accepted. Est. Value Notes: 250000 Construct new water well complete with all appurtenances for a fully operational system as shown in the plans and described in the specifications. Approximately 700' of 8" waterline extension class 200 PVC and all appurtenances. Concrete pads with generator and propane tank. Transfer switch. Electrical service pole with fuse disconnect. Graveling and fencing site. American Iron and Steel (AIS) requirements apply. The envelope(s) containing the bid(s) must be sealed, addressed to the Garfield Co. RWD #5 and designated as Bid for Well No. 3. The Owner may consider informal any bid not prepared and submitted in accordance with the provisions hereof and may waive any informalities or reject any and all bids. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. No bidder may withdraw a bid within 90 days after the actual date of the opening thereof. Bids will not be accepted by the owner more than 72 hours prior to the scheduled bid opening. Telegraphic Modification Any bidder may modify his bid by telegraphic communication at any time prior to the scheduled closing time for receipt of bids, provided such telegraphic communication is received by the Owner prior to the closing time, and provided further the Owner is satisfied that a written confirmation of the telegraphic modification over the signature of the bidder was mailed prior to the closing time. The telegraphic communication should not reveal the bid price but should provide the addition or subtraction or other modification so that the final prices or terms will not be known by the Owner until the sealed bid is opened. If written confirmation is not received within two days from the closing time, no consideration will be given to the telegraphic modification. Method Bidding The Owner invites the following bid(s) for the Well No. 3. Qualification of Bidder The Owner may make such investigations as he deems necessary to determine the ability of the bidder to perform the work, and the bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein. Conditional bids will not be accepted. Bid Security Each bid must be accompanied by cash, certified check of the bidder, or a bond prepared on the form of bid bond attached hereto, duly executed by the bidder as principal and having as surety thereon a surety company approved by the Owner, in the amount not less than 5% of the bid. Such cash, check or bid bond will be returned, if requested, to all except the three lowest bidders within three days after the opening of bids, and the remaining cash, check or bid bond will be returned, if requested, promptly after the Owner and the accepted bidder have executed the contract, or if no award has been made within 30 days after the date of the opening of bids, upon demand of the bidder at any time thereafter, as long as he has not been notified of the acceptance of his bid. Liquidated Damages for Failure to Enter into Contract The successful bidder, upon his failure or refusal to execute and deliver the contract and bonds required within 10 days after he has received notice of the acceptance of his bid, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the security deposit with his bid. Time of Completion and Liquidation Damages Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" of the Owner and to fully complete the work within 90 consecutive calendar days. Bidder must agree also to pay as liquidated damages, the sum of $600.00 for each calendar day thereafter as hereinafter provided in the General Conditions. Condition of Work Each bidder must inform himself fully of the conditions relating to the construction of the project and the employment of labor thereon. Failure to do so will not relieve a successful bidder of this obligation to furnish all material and labor necessary to carry out the provisions of his contract. Insofar as possible the contractor, in carrying out his work, must employ such methods or means as will not cause any interruption of or interference with the work of any other contractor. Any item required to complete the project to have a complete functional facility or required by the specifications for which bid items are not set up shall be included in other bid items. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the contract throughout. Addenda and Interpretations No interpretations of the meaning of the plans, specifications or other pre-bid documents will be made to any bidder orally. Every request for such interpretation should be in writing and addressed to: WDB ENGINEERING P.L.L.C., 6330 S.E. 74TH Street, Oklahoma City, OK 73135, and to be given consideration must be received at least five days prior to the date fixed for the opening of bids. Any and all such interpretations and any supplemental instruction will be in the form of written addenda to the specifications which, if issued, will be mailed by certified mail with return receipt requested to all prospective bidders (at the respective address furnished for such purposes), not later than three days prior to the date fixed for the opening of bids. Failure of any bidder to receive any such addendum or interpretation shall not relieve such bidder from any obligation under his bid as submitted. All addenda so issued shall become part of the contract documents. Security for Faithful Performance Simultaneously with the delivery of the executed contract, the Contractor shall furnish a Performance Bond, Statutory Bond and Maintenance Bond or Bonds, each in the amount of 100% of the contract price, as security for faithful performance of this contract and for the payment of all persons performing labor on the project under this contract and furnishing materials in connection with this contract, as specified in the General Conditions included herein. The surety on such bond or bonds shall be a duly authorized surety company satisfactory to the Owner. Power of Attorney Attorneys-in-fact who sign bid bonds or contract bonds must file with each bond a certified and effectively dated copy of their power of attorney. Notice of Special Conditions Attention is particularly called to those parts of the contract documents and specifications which deal with the following: a. Inspection and testing of materials b. Insurance requirements c. Stated allowances d. Time of completion Laws and Regulations The bidder's attention is directed to the fact that all applicable Federal or State laws, municipal ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the project shall apply to the contract throughout, and they will be deemed to be included in the contract the same as though herein written out in full. Method of Award - Lowest Qualified Bidder If at the time this contract is to be awarded, the lowest base bid submitted by a responsible bidder does not exceed the amount of funds, then estimated by the Owner as available to finance the contract, the contract will be awarded on the base bid only. If such bid exceeds such amount, the Owner may reject all bids or may award the contract on the base bid combined with such deductible alternates applied in numerical order in which they are listed in the Form of Bid, as produces a net amount which is within the available funds. Tied bids are non-restrictive. In order for a tied bid proposal to be accepted, it must be lower than the sum of low separate bids. Obligation of Bidder At the time of the opening of bids, each bidder will be presumed to have inspected the site and to have read and to be thoroughly familiar with the plans and contract documents (including all addenda). The failure or omission of any bidder to examine any form, instrument or document shall in no way relieve any bidder from any obligation in respect of his bid. SCOPE OF CONTRACT The contract consists of furnishing and constructing all material and equipment for a Well No. 3 as shown in the plans and described in the specifications. Davis Bacon Act This project is subject to the Davis Bacon Act and prevailing wage rate requirements. System for Award management (SAM) System for Award Management (SAM) registration is required for all DWSRF program applicants and Awardees (Entities, prime contractors, subcontractors, vendors) in order to be awarded contracts by the DWSRF program. SAM replaces Central Contractor Registration/Federal Agency Registration, Online Representations and Certifications Application, and Excluded Parties List System. Applicants and awardees are required to complete a one-time free registration to provide basic information relevant to procurement and financial transactions. Note: In order to register in SAM, a Data Universal Number System (DUNS) number will be required. DUNS number is a unique, non-indicative 9-digit identifier issued and maintained by Dun & Bradstreet (D&B) that verifies the existence of a business entity globally. D&B assigns DUNS numbers for each physical location of a business. All entities doing business with the U.S. Government can receive a DUNS number FREE of charge and, under normal circumstances, within 1-2 business days when using the D&B web form process online. Executed Agreement and Bonds Contractor shall submit executed agreement and bonds within 10 days after its receipt from the owner. Owner shall return executed copy of the agreement within 10 days after its receipt from the contractor. Owner shall issue a Notice to Proceed within 10 days after the Owner executes the agreement. Contractor shall begin construction within 10 days of the date shown on the Notice to Proceed. Conflict Statements In the event of a conflict between the specifications and the DWSRF Supplemental Conditions (DW-185 "Pink Sheets"), the latter shall govern. In the event of a conflict between the plans and specifications, the specifications shall govern.
