The Work for which Bids are asked includes installation of a new section of the roadway including but not limited to the following: Preparation of the existing site by grading 7,400 square yards, excavating 3,000 linear feet of roadside swales, installing 2,700 tons of road base, installing 725 tons of asphalt pavement, installing 2,800 linear feet of gravel shoulder, and restoring the site. All questions about the meaning or intent of the Bidding Documents are to be submitted to Engineer in writing. Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by Addenda mailed or delivered to all parties recorded by Engineer as having received the Bidding Documents. Questions received less than ten days prior to the date for opening of Bids may not be answered. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. There are no prevailing wage rates for this contract. Bids must be accompanied by bid security in the form of a certified check or bid bond equal to five percent of the maximum bid price, payable to the Owner as a guaranty that if the Bid is accepted, the Bidder will execute the Contract Documents and furnish the required contract security. If the Successful Bidder fails to execute the Contract Documents [and provide the required contract security within 15 days after the Notice of Award, the Owner may annul the Notice of Award and the Bid Security will be forfeited. Bids may not be withdrawn within 60 days after the date of the bid opening. The Owner reserves the right to reject any or all Bids, and to award the Contract to the Bidder, who in the judgment of the Owner, will best serve the interest of the Owner.
