This solicitation is for the rehabilitation, replacement, and/or installation of concrete curb, gutter, sidewalk, aprons, storm structures, etc. on an as-needed basis as determined by the Town of Purcellville. The Scope of Work is more fully set forth in the Bid and Contract Documents, which are available for download from the Town's Bid Board. All questions regarding this bid must be received in writing by email at dcopeland@purcellvilleva.gov until 11:59 PM on March 9, 2025. Bid shall be accompanied by a Bid Bond in the amount of 5% of the Contract value. Bid Bond shall be prepared in the format given in Section 6, Appendix A. Each bid must be accompanied by (1) cash; or (2) a Cashier's Check or a certified Check of the Bidder in an amount not less than five percent (5%) of the bid, made payable to the Town of Purcellville or; (3) a bidder's bond on the Bid Bond Form provided in the Bid Document, or on a similar form which materially complies with said Bid Bond form, in the amount of five percent (5%) of Bidder's bid. PLEASE NOTE: The amount of a bid bond shall not exceed five percent (5%) of the amount bid pursuant to Sec. 2.2-4336 (Code of Virginia). For purposes of this provision, the amount of the bid shall be the total of base bids or the alternative bid, whichever is greater. The Bid Bond shall be issued by a surety company acceptable to the Owner that is licensed to conduct business in Virginia and authorized by the United States Department of the Treasury on Department Circular 570, 2022 Version. See the Standard General Conditions of the Construction Contract, Article 6 - Bonds and Insurance, Section 6.01 (C). Bid security shall be returned to all but the three (3) lowest responsive and responsible Bidders and remaining security will be returned within forty-eight (48) hours after the Owner and the successful Bidder have executed the contract. If no contract has been awarded or the Bidder has not been notified of the acceptance of its bid within sixty (60) calendar days of the bid opening, the Bidder may withdraw its bid and request the return of its bid security. If, at the Owner's request, the Bidder agrees to extend and maintain its bid beyond the specified sixty (60) calendar days, the Bidder's bid security will not be returned until forty-eight (48) hours after the contract has been executed. The Successful Bidder agrees that, upon its failure or refusal to execute the Contract within ten (10) calendar days after it has received notice of the acceptance of its Bid, it shall forfeit to the Owner the security deposited with its bid, not as a penalty, but as reasonable liquidated damages for such failure or refusal. Such forfeiture shall be the lesser of (i) the difference between the bid for which the bond was written and the bid of the next lowest responsive and responsible bidder to this IFB to whom a contract is awarded; or (ii) the face amount of the bid bond. CONTRACT PERIOD - the Contract awarded under this IFB shall cover a one year period from the date of the Contract award. The Contractor agrees that for unit price contracts, prices shall remain firm for the duration of the one-year period. The Contract may be renewed upon the same terms and conditions at the expiration of its term for a maximum of four (4) one-year renewal periods by mutual agreement between the parties. Notice of intent to renew will be given to the Contractor in writing by the Town of Purcellville, normally sixty (60) days before the expiration date of the current contract. Failure to give such notice will not constitute a breach of this contract. This notice will not be deemed to commit the Town of Purcellville to a contract renewal.
