1 Road Resurfacing and Maintenance The Town of Stoughton invites bids in accordance with M.G.L. 30-39M for Road Resurfacing and Maintenance to be provided to the Town of Stoughton as needed under the direction of the DPW Superintendent or designee. The contract term is set for one (1) year with two (2) additional one (1) year options to renew based on the sole recommendations of the Town. The Town of Stoughton reserves the right to accept or reject any and all bids. The awarded contract shall endeavor to meet Workforce Participation Goal Requirement under M.G.L. c. 149 44 (2)(G) which are currently 6.9% for women and 15.3%A for minorities. This is required due to funding (in part or in whole) by the Commonwealth of Massachusetts. At any point during the contract period, the Town of Stoughton may require of the Contractor a report of the projected or current makeup of the Contractor's workforce per M.G.L. C. 149 44 (2)(G). Failure to submit this report when required could result in penalties as enumerated in the statue. The Town intends to seek reimbursement of costs of certain work, under the Mass. Department of Transportation / Mass. Highway Department (hereinafter MassDOT) "Chapter 90" program. Work performed on such projects must be by MassDOT-prequalified firms, when work is estimated to be in excess of certain dollar limits. Therefore, for purpose of this bid solicitation: Any award for an item called out as "Chapter 90 Award Item" must be to a firm appearing on a MassDOT "prequalified bidder list" as furnished to the Town of Stoughton for the category of work in said award. PRE-QUALIFICATION Bidders must be prequalified by the Massachusetts Department of Transportation in accordance with Massachusetts General Law Chapter 81, Section 8B. All responsive and responsible bidders must be prequalified by MassDOT for this value of work to be eligible for award. Project dollar estimates provided to MassDOT by the Town were preliminary and in no way or commitment to purchase such amounts. These figures are given to indicate approximate dollar ranges used for purposes of the MassDOT application/certification process only. Vendors are advised that the initial contract term is for one year. r. Awarding Authority reserves the right to extent the contract for two additional 12 month options. Valuation for purposes of MassDOT Prequalification is based on first year times three (3) to arrive at an estimated total Prequal contract value. Contractors who are not prequalified to provide the services listed for the total Prequal contract value, but meet the single year waiver threshold, without documented poor performance issues, and want to bid, should submit a waiver request at least weeks prior to the bid opening to allow for time to appeal in the event that a waiver is not granted. The estimated value provided in the Invitation to Bid is for one year. Vendors are expected to be able to provide their services over three years at three times the initial estimated value.
