Bid security in an amount equal to at least five percent (5%) of the bid made payable to the Saginaw County Road Commission must accompany each bid. The bid security must be either: (1) lawful moneys of the United States, or (2) a cashier's check, certified check, bank money order, or bank draft drawn and issued by a national banking association located in the State of Michigan, or (3) a bid bond or bonds executed by a surety corporation authorized to do business in the State of Michigan. Each bidder is deemed to covenant that if he/she is awarded the contract he/she will, within ten (10) days from the written Notice of Award, enter the formal contract and execute and deliver a Performance and Payment Bond equal to one hundred percent (100%) of the contract, and in the event that said bidder fails, neglects or refuses to enter into the contract or to supply the necessary bond as herein provided, the bid security accompanying his bid and the amount therein mentioned shall be declared to be forfeited to the Saginaw County Road Commission and shall be collected by it and paid into the general fund. The Board of County Road Commissioners of Saginaw County, Michigan, hereby notifies all bidders that it will affirmatively insure that in any contract entered into resultant from this advertisement, minority business enterprises will be afforded full opportunity to submit bids and not be discriminated against on the grounds of race, color, sex, or national origin. All successful bidders must meet state and federal laws and rules with regard to equal opportunity employment. Contractors will comply with all rules and regulations of the Michigan Department of Labor relative to minimum wages and such rules and regulations of the Fair Employment Practices Act, various departmental rules of the federal, state and local governments as may relate to minority hiring and employment. The County Road Commission reserves the right to reject any or all bids, to waive any technicalities, and to accept any bid which it deems advantageous to the County. No bid shall be withdrawn after the opening of bids without consent of the County Road Commission for a period of thirty (30) days.
