Site work and renovation of a mixed-use development in Early, Texas. Completed plans call for the renovation of a playground / park / athletic field; for site work for a playground / park / athletic field; and water / sewer project.

Project scope includes but is not limited to renovations to restroom building including electric door strike package. 1.1. Specifications The guiding specifications for this project will be the 2015 International Family of Codes and the 2014 National Electric Code. The planset titled "CITY OF EARLY PARK BUILDING" drawn by Meers Engineering and signed and sealed by Larry Jerome Meers on 4/3/2023 shall act as the construction documents for this project. 1.2. Award Criteria The bid for this project will be awarded based on the "Best Value" for the City of Early, Texas, as authorized by Section 252.043(b) of the Texas Local Government Code, which considers the following factors: Construction price Reputation of the bidder and the bidder's goods or services Quality of the goods or services The extent to which the goods or services meet the municipality's needs Past relationship with the municipality Compliance with contracting rules for historically underutilized businesses and non-profit organizations employing persons with disabilities Long-term costs to the municipality Any relevant criteria specified in the RFP 1.3. Right to Reject Bids The City Council reserves the right to reject any and all bids, as authorized by Section 252.043(f) of the Texas Local Government Code. 1.4. Bonds and Performance The contractor will be required to provide bid and performance bonds as specified in Section 252.044 of the Texas Local Government Code and Chapter 2253 of the Texas Government Code. The bid bond is due at the time of bid submission. Please use the form in this RFP for submitting the bid bond. Performance bond is due at contract signing. The Surety Company will provide a submission form for the performance bond. 1.5 Contract The Contract will consist of all bidding documents, surety bonds, construction documents, and addendums (if any) issued during the bidding process. 2. SCOPE OF WORK 2.1. General Condition Notes All items listed in the Toilet Accessory Legend (A2.04) must be commercial grade and designed for durability in an unsupervised public park setting, with resistance to vandalism and heavy use. Acceptable brands for items in the Toilet Accessory Legend are Bradley, American Specialties, or Bobrick. The color preference for the drinking fountain is Brown. Electronic Door strikes shall be equivalent to the Altronix package attached All color and equipment choices will be selected through a submittal process after bid awarding. 2.2. Contractor General Notes The Contractor will be responsible for electrical and plumbing connections to the lift tank. The Contractor will be responsible for the ditch and conduit to the Oncor transformer located approximately 30 feet to the west of the building. The Contractor will be responsible for securing the construction site from public access and maintaining pedestrian access to the sidewalk and walkways or designating an alternative pathway approved by the City of Early. 2.3. City General Notes The City of Early will provide and install the lift tank depicted just off the northeast corner of the building. The City will install the sewer line from the main line to the lift tank. The City will provide a 2" water line to within 10 feet of the construction site. 2.4. Other Considerations Disposal of surplus materials is the responsibility of the contractor. Dirt spoilage can be stockpiled on site; see Larry McConn for locations of spoil piles. No construction materials or construction equipment will be allowed to be stored in the existing parking lot. The contractor must seek approval for staging areas or material stockpiles on City property. Contact Larry McConn at 325-643-5451 for more information. No trees may be removed or trimmed without prior approval from the City. The contractor must maintain grade control to ensure positive drainage at all times. 1. Pre-Construction Conduct site survey and soil testing. Provide adequate barriers to establish construction area. 2. Site Preparation 3. Foundation & Utilities 4. Building Construction 5. Interior Work 6. Final Site Work 7. Testing & Inspections Ensure ADA compliance and accessibility features. Address final punch list items and make necessary corrections. 8. Closeout & Turnover Perform the final cleaning of the facility. Conduct a final walkthrough with City Officials. Provide operation manuals, warranties, and as-built documentation. 4. PROJECT SCHEDULE AND PROGRESS 4.1. Submission of Schedule The contractor must submit their proposed project schedule as part of the bidding process for review and approval by the City of Early. 4.2. Bar Chart Scheduling The contractor will update and submit a Bar Chart schedule biweekly. 5. SODDING AND LANDSCAPING 5.1. Block Sodding Sodding will be completed by the City of Early. The contractor will prepare the area with 4" topsoil suitable for sodding, free of debris. The City of Early will provide the topsoil for use behind the curbs and around sidewalks. 5.2. Fertilizer and Watering Fertilizer and vegetative watering will also be handled by the City of Early. 6. INSPECTIONS AND WARRANTY 6.1. Inspections Permits are required for this project, however, there will be no charge for the permits. The General Contractor and all subcontractors will be required to register with the city of Early. The City of Early will act as the project inspector. Contractors should contact Early City Hall (325-643-5451) 24 hours in advance of inspection requests The Contractor will be financially responsible for any inspections that require additional call-outs. If charges are incurred by the City for an inspector to reinspect a failed inspection, those charges will become the responsibility of the contractor. 6.2. Warranty The contractor must warranty their work and materials for one year from the project's completion and acceptance. 7. PROJECT CONTROL AND SURVEYING 7.1. Project Control The contractor must maintain project control markers throughout construction. 7.2. Surveying The need for surveying on this project should not be necessary. Control for grades will be established by the adjacent curb and sidewalk locations. 8. SAFETY REQUIREMENTS This project is located in a public park adjacent to sidewalks used by the general public. Access to the park must remain open to the general public during construction The contractor will be responsible for maintaining a construction barrier around the project throughout construction that is adequate to keep the public out of the construction site. 9. FINAL CLEAN-UP Upon project completion, and before final acceptance and payment, the contractor must remove all surplus materials, debris, and construction remnants, leaving the site in a clean, orderly condition. In the space provided below, please enter your total bid amount for this project. This amount is the only figure that will be publicly read at the bid opening. Authorization for bid approval will be based on the "best value" criteria, as authorized by the City Council of Early, under Texas Local Government Code Section 252.043. The City Council retains the right to reject any and all bids. Bid Submission Security Each bid submission must be accompanied by either: A certified check issued by the bidder, or A bid bond executed by the bidder as the principal, with a surety company approved by the City. The bid bond must be in the amount of 5% of the total bid. The Surety's Power of Attorney must accompany the bid bond and must bear the same date as the bond, which cannot be earlier than three (3) days prior to the scheduled bid opening date. Return of Checks Certified checks will be returned to all bidders except the three lowest within three (3) days after the opening of bids. The remaining checks will be returned promptly after the contract has been executed between the City and the selected bidder. Return of Security if No Award If no award is made within ninety (90) days after the bid opening, a bidder may request the return of their security, provided that the bidder has not been notified of the acceptance of their bid. Forfeiture of Bid Security If the selected bidder refuses or fails to execute and deliver the required contract and performance/payment bonds within 10 days of receiving notice of bid acceptance, the bid security will be forfeited to the City as liquidated damages for the bidder's failure or refusal to proceed. Bid Bond Form A Bid Bond form is included in the Appendices of this document. IT IS EXPRESSLY UNDERSTOOD AND AGREED that if the said Principal should withdraw its bid at any time after the bid is opened and before the official rejection of such bid, or, if successful in securing the award thereof, the said Principal should fail to enter into the contract and furnish, if required, satisfactory performance and payment bonds, the Obligee, in either of these events, shall be entitled to collect the full amount of this Bid Bond as liquidated damages. The Surety, for value received, hereby stipulates and agrees that the obligation of said Surety and its bond shall not be impaired or affected by any extension of the time within which the Obligee may accept such bid. The Surety also waives notice of any such extension. PROVIDED, further, that if any legal action be filed upon this bond, venue shall lie in Brown County, Texas. IMPORTANT INSTRUCTIONS: Submit an original bid bond along with a certified copy of the Power of Attorney and full contact information for the Surety. Both the bid bond and Power of Attorney must be dated the same day, and that date must be no earlier than three (3) business days prior to the scheduled bid opening. Example: For a bid opening on Thursday, count back Wednesday, Tuesday, and Monday as the acceptable dates. If the bid opening is delayed or rescheduled, the Principal and/or Surety may be required to provide proof that the bid bond remains valid. The City Council reserves the right to reject any and all bids, as authorized by Section 252.043(f) of the Texas Local Government Code.
