The SERVICE PROVIDER shall maintain existing beds, plants, shrubs and hedges in accordance with the rules of landscaping for sites listed in Appendix A. As a reference, the CIUSSS de l’Estrie – CHUS wishes to be maintained in accordance with the standards of the City of Sherbrooke’s flowerbeds, which are often found near its sites. See photos as examples of what is desired and acceptable in the PDF document entitled “Site Plans and Photos” attached to the Tender Documents. The Head of Technical Services at RLS de Sherbrooke remains at all times the principal contractor and may authorize, delay or refuse, in whole or in part, works and is the reference person for the execution of this contract.The successful tenderer shall provide sufficient and qualified labour as well as adequate equipment necessary for the execution of the work listed in this Specification. It will be the responsibility of the contractor to have sufficient equipment and manpower to meet the requirements of this specification and to complete the work within the required time frame. The successful tenderer must maintain all of his equipment in good working order.The bidder shall identify in its bid the name of the person who will be responsible for this contract and who will be on site during the execution of the work.The contractor must take all necessary safety measures to protect the public and its employees during the work.The successful tenderer will accept a member of the Technical Service to Buildings (STB) to familiarize him with the work in progress, and this throughout the duration of the work. The supervision exercised by the representative of the STB does not in any way release the contractor from responsibility.The successful bidder will be responsible for the dress of its employees, he must ensure a decent and easily identifiable dress on behalf of the successful company. For example, wearing a shirt clearly identified in the name of the company. All persons employed by the contractor must wear appropriate safety equipment and personal protective equipment (PPE) at the workplace.The successful bidder is solely responsible for any accident caused by him or his employees to any person, or damage caused to establishments of the RLS of Sherbrooke or property of others. A preferential margin of 10% will be granted to the BIDDER who meets the following criteria, with supporting evidence: Criteria:a)- Be a social economy enterprise whose social purpose is that which is not centred on pecuniary profit, but on service to members or the community and which is operated in accordance with the following principles: 1. the purpose of the business is to meet the needs of its members or the community; 2. the company is not under the decision-making control of one or more public bodies within the meaning of the Act respecting access to documents of public bodies and the protection of personal information (chapter A-2.1); 3. the rules applicable to the company provide for democratic governance by members; 4. the company aspires to economic viability; 5. the rules applicable to the company prohibit the distribution of surpluses generated by its activities or provide for a distribution of these to members in proportion to the transactions carried out between each member and the company; 6. the rules applicable to the legal person who operates the business provide that in the event of dissolution, the remainder of its assets must be transferred to another legal person with similar objectives. The total submitted price of any BIDDER who meets the above criteria and who provides the required evidence, is then reduced by the value of the preferential margin of 10% only for the purposes of determining the successful tenderer, without affecting the prices on the Price List.
