Renovation of a theater / auditorium in Louisville, Mississippi. Completed plans call for the renovation of a theater / auditorium.
BID GUARANTEE: Proposals shall be submitted with Proposal Security in the form of Certified Check or acceptable Bid Bond in an amount equal to at least five percent (5%) of the base bid; such security is to be forfeited as liquidated damages, not penalty, by any bidder who fails to carry out the terms of the proposal. The Bid Bond, if used, shall be payable to the Owner. Bonds on the project must be received on or before the period scheduled for the project and no bid may be withdrawn after the scheduled closing time for the project. Bids must be firm for forty-five (45) days after the scheduled opening time. PERFORMANCE-PAYMENT BOND: A 100% Performance-Payment Bond issued by a surety company authorized to do business in the State of Mississippi will be required within ten (10) days after the successful bidder has been notified of the award of the contract to him. The Project is the renovation of the Front Lobby area of the Strand Theater. B. The work shall include all labor, materials, equipment, services, and related activities and procedures necessary to the complete construction including the lobby renovation, mechanical, plumbing, electrical, and other improvements as shown on the Drawings and required in the Specifications (Project Manual). The Owner reserves the right to reject any or all bids and to waive irregularities. GENERAL INFORMATION A. Should a bidder find discrepancies in or omissions from the drawings or specifications or be in doubt as to their written meaning, the bidder should immediately notify the Architect who will then send a written instruction or interpretation to all known holders of the documents. Neither the Owner nor the Architect will be responsible for oral instructions or any other communications not included in the documents or addenda. B. It is understood and agreed that refinement and detailing of the drawings and specifications will occur from time to time. No adjustment in the contract sum or completion date shall be made unless such refinement results in changes to the scope, quality, or function of the work not reasonably inferable or anticipatable. Notwithstanding anything contained in this Contract to the contrary, the Contractor will receive no increase in the contract sum based on the increased cost of the work resulting from change orders or increased cost of any allowance items unless the change required is beyond the scope of the work. C. The Contractor shall not use in the project any new materials containing asbestos, asbestos products, polychlorinated biphenyl (PCB), or other toxic substances. If the Contractor discovers that such substances as described herein have been specified or do exist in the project, the Contractor shall promptly notify the Architect in writing and make substitutions for these products at no cost to the Owner.
