Each bidder must electronically submit with his bid a certified or a cashier's check upon some reputable bank of the State of Minnesota, payable to the City of Moorhead, for at least 5 (five) percent of the total amount of such bid, which check and the amount thereof, shall be forfeited to the City of Moorhead, as liquidated damages if the bidder upon the letting of the contract to him, shall fail to enter into the contract so let. The bidder may electronically submit a bidder's bond written through an insurance agency or cash in the same amount in lieu of a certified check. The successful bidder will be required to furnish contract performance and payment bonds, each in the full amount of the contract. The Owner reserves the right to retain the deposits of the 3 lowest Bidders for a period not to exceed 30 days after the date and time set for the Opening of Bids. No Bids may be withdrawn for a period of 30 days after the date and time set for the Opening of Bids. The Owner reserves the right to reject any and all Bids, to waive irregularities and informalities therein, and further reserves the right to award the Contract in the best interests of the Owner.
