Bidders shall be pre-qualified pursuant to Ordinance No. 26,614 approved by the City Council on December 8, 2020, or qualified as otherwise specified in the Bidding Documents. All affidavits and certifications identified and listed herein as Bidding Documents shall be properly executed and accompany the bid of each Bidder. Bids electronically deposited more than ninety-six (96) hours, excluding Saturdays, Sundays, and holidays, before time set for opening of bids, as well as bids received after time set for opening of bids, will not be considered. The Oklahoma City Airport Trust reserves the right to reject any and all bids and to waive any and all informalities. The Trust may require up to one hundred twenty (120) days from bid opening date to award of contract. Upon submitting a Bid, the Bidder has provided their agreement to extend the award up to the one hundred twenty (120) days from the bid opening date. Award of this Contract is contingent upon the Trust's receipt of a Federal grant for this Project. This is a Federally funded project, for which the following notices are hereby provided: The Oklahoma City Airport Trust, in accordance with Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. __ 2000d to 2000d-4) and the Regulations, hereby notifies all Bidders that it will affirmatively ensure that, for any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and no business will be discriminated against on the grounds of race, color, national origin (including limited English proficiency), creed, sex (including sexual orientation and gender identity), age, or disability in consideration for an award. The Oklahoma City Airport Trust's award of this contract is conditioned upon Bidder satisfying the good faith effort requirements of 49 CFR _ 26.53. As a condition of responsiveness, every Bidder or Offeror must submit the following information with its proposal on the forms provided herein: A. The name and address of each participating DBE firm that will participate in the contract; B. A description of the work that each DBE firm will perform; C. The dollar amount of the participation of each DBE firm listed under (1); D. Written statement from Bidder that attests their commitment to use the DBE firm(s) listed under (a) to meet the Oklahoma City's Airport Trust's project goal; E. Written confirmation from each listed DBE firm that it is participating in the contract in the kind and amount of work provided in the prime contractor's commitment (see DBE Letter of Intent form provided in the Project Manual) and; F. If Bidder cannot meet the advertised project DBE goal, evidence of good faith efforts undertaken by the Bidder as described in appendix A to 49 CFR Part 26. The documentation of good faith efforts must include copies of each DBE and non-DBE subcontractor quote submitted to the bidder when a nonDBE subcontractor was selected over a DBE for work on the contract. Bidders are further notified that any contract entered into pursuant to this Solicitation for Bids will be subject to the following Federal Solicitation Requirements, which are hereby incorporated by reference as though fully set forth herein: _ Affirmative Action for EEO Clause and Specifications.
