The intent of the Contract Documents is for the Contractor to provide for construction and completion, in every detail, of the Work described or reasonably inferable therefrom. It is further intended that the Contractor shall furnish all necessary superintendence, labor, machinery, Equipment, tools, Materials, transportation and supplies required to complete the Work in accordance with the Plans, Specifications, and all other terms of the Contract Documents. Any failure or neglect on the part of Owner to enforce provisions dealing with supervision, control, inspection, testing, or acceptance and approval of the Work shall never relieve Contractor from full compliance with the Contract Documents nor render the Owner liable to the Contractor for damages, extensions of time, or increased compensation of any kind. The Contract Documents contain instructions and descriptions covering the construction and workmanship necessary for building and completing the various units or elements of the Work. The Contract Documents are intended to be so written that only first class material, workmanship, and finish of the best grade and quality will result. The fact that the Contract Documents may fail to be so complete as to cover all details will not relieve the Contractor of full responsibility for providing a completed Project of high quality, first class finish and appearance, and satisfactory for operation, all within the intent of the Contract Documents. Accordingly, the Contractor shall supervise and direct the Work using in a good and workmanlike manner, in accordance with the professional and other standards imposed by applicable laws and the Contract Documents, using the Contractor's best skill and attention, and shall in all cases act in the Owner's best interests and act in good faith in connection with the Work. The Contractor shall be solely responsible for, and have control over, construction means, methods, techniques, sequences and procedures, and for coordinating all portions of the Work. The Contractor shall be responsible for inspection of portions of Work already performed to determine that such portions are in proper condition to receive subsequent Work. Design professionals, e.g., architects, engineers, and similarly licensed professionals, shall perform their part of the Work in accordance with the professional skill and care ordinarily provided by competent engineers, architect, or other applicable professionals practicing under the same or similar circumstances and professional license, and as expeditiously as is prudent considering the ordinary professional skill and care of a competent engineer, architect, or other applicable professional.
