Notwithstanding any liquidated damages/economic disincentives provisions contained in the Contract Documents, in the event Owner is damaged in the course of the Work by the act of negligence, omission, mistake, or default of the Contractor Parties or intentional acts or omissions of the Contractor Parties or should the Contractor Parties delay the progress of work by others on the Project or the projects of Owner so as to cause loss or liability to Owner, then Contractor shall reimburse Owner for such loss, including attorney's fees, and Owner's damages shall not be capped by any liquidated damages/economic disincentives provisions in the Contract Documents. The Owner reserves the right to reject any or all Bids and to waive all defects and irregularities in bidding or bidding process except the time for submitting a Bid.
