PAYMENT METHOD Invoices based upon fixed sums for deliverables or work completed. A 5% bid discount will apply to bids from M/WBEs for contracts of $300,000 or less. The discounted amount will be used in evaluating bid prices, but the actual bid amount will be the basis for the contract award. "M/WBE" means a Minority and Women-Owned Business Enterprise that is certified by Missouri Department of Transportation (online) or St. Louis Development Corporation (SLDC). A. A minority-owned business enterprise (MBE) is a for-profit enterprise at least 51% owned, operated, and controlled by a minority group member who is Asian, Black, Hispanic, or Native American. B. A woman-owned business enterprise (WBE) is a for-profit enterprise at least 51% owned, operated, and controlled by a female. Failure to meet an MBE or WBE participation goal, or make good faith effort to do so, during the term of this contract may constitute a material breach of contract and may subject a Contractor to the imposition of liquidated damages unless the Contractor can provide evidence, acceptable to the County, of having made Good Faith Efforts to meet the goals. Failure to Meet the Project Schedule Liquidated damages of $200 per calendar day may be imposed for delays of mobilizing, and for substantial completion. Prior to liquidated damages being imposed, the County will issue a formal notice to the contractor and will state a time by which correction must be made. Failure to Meet M/WBE Goals Liquidated damages, if assessed, will be assessed based on the M/WBE goal shortfall, or lack of good faith effort, and may not exceed the difference between the monetary amount of the participation goals set by this contract and the amount actually paid to MBEs and WBEs. The County's rights and remedies under this paragraph are not exclusive and are in addition to any other rights or remedies provided by law. The County reserves the right to examine all laptops, flash drives, and other media on persons entering or leaving County property.
