Closing Time: 3:00 PM (NT) ** Please note that there has been 3 addendum issued for this tender. ** Question Acceptance Deadline 2025/07/03 03:00:00 PM NDT The role of the Independent Certifier includes the services described in Independent Certifier Agreement of the Project Agreement, attached to this RFP as Appendix "A" and the services summarized below: From the date of the Project Agreement until 60 days following Service Commencement, the Independent Certifier shall consult with the Design-Builder and others involved in the Design and conduct inspections of the Construction for purposes of preparing and delivering a to the Authority and Project Co a monthly written report containing a description of. (a) the Design and Construction completed in the previous month; and (b) the progress of the Design and Construction relative to the Updated Project Schedule, with an overview analysis of any variances and an assessment of whether the Project is on time and on budget. In addition, the Independent Certifier shall receive from Project Co, at least 30 days (but no more than 60 days) before the Target Service Commencement Date, a notice setting out: (a) a description of all outstanding Design and Construction to be completed by Project Co prior to Service Commencement, and (b) a list of all Defects that Project Co is aware of at the time of the notice, thereby allowing the Independent Certifier to make any advance inspections necessary to certify Service Commencement. In addition, the Independent Certifier shall provide the Certification Services with respect to Construction Period Payments as set out in Schedule 8 Appendix 8C Construction Period Payments. For reference, this schedule is attached to this RFP as Appendix B. Within 5 Business Days of receiving an application for a Certificate of Service Commencement from Project Co, the Independent Certifier shall inspect the Facilities to determine if the requirements for Service Commencement, as detailed in the Project Agreement, have been achieved. These include, but are not limited to the following: (a) an occupancy permit, a temporary occupancy permit or other written permission that is sufficient for occupancy of the Facility by the Authority for the Authority Activities has been issued by the appropriate municipality; (b) Project Co has tested and confirmed that all relevant Equipment has been installed in the Facility in accordance with the manufacturer's requirements and is functioning in accordance with the specifications included in the relevant Equipment purchase contract or purchase order, (c) Project Co has delivered to the Authority a report from the commissioning agent retained by Project Co confirming completion of all commissioning activities scheduled in the Commissioning Plan to be completed before Facility Service Commencement in respect of the Facility; (d) Project Co has completed the training of Authority staff for the Facility as required by the Design and Construction Protocols; (e) Project Co has delivered to the Authority a Life Cycle Schedule and Start-up Plan as required by Services Protocols and Specifications; (f) Project Co has delivered to the Authority a statutory declaration on CCDC Form 9A concurrently with its application for a Certificate of Facility Service Commencement; and (g) solely in respect of the last Facility to achieve Facility Service Commencement, the Architect has certified "completion of the contract" in respect of the Facilities in accordance with the Mechanics' Lien Act (Newfoundland and Labrador). To aid the Independent Certifier in the performance of their work, Project Co shall: (a) give the Independent Certifier access to the Relevant Lands and to the Design and Construction as the Independent Certifier reasonably requests in order to be fully informed as to the progress of the Design and Construction including access to drawings, specifications, schedules, records, and other documents or data relating to the Design and Construction, including such information that is being produced by or in the possession of the Design-Builder or others; (b) permit the Independent Certifier to attend all Design and Construction meetings during the Construction Period except to the extent Project Co and the Authority expressly otherwise agree; (c) keep the Independent Certifier fully informed as to the progress of the Construction, including giving notice in accordance with Good Industry Practice of any part of the work on the Facility before it becomes covered up and unavailable for inspection; and (d) Provide upon request by the independent certifier, copies of equipment invoices showing costs for all equipment and materials delivered to the site or stored off site as agreed to and provided for under this agreement.
