If the Contractor fails to achieve Beneficial Occupancy and/or Substantial Completion and/or Final Completion within the times specified in the approved Schedule or any approved extension thereof, the Contractor shall be liable to the SCA, for the amount specified in the table below, as liquidated damages for each and every continuous calendar day that the Contractor shall be in default, in addition to any other liability that the Contractor may have to the SCA. Value of Job Order Liquidated Damages $0 to $10,000 $100/Day $10,001 to $50,000 $250/Day $50,000 to 250,000 $500/Day $250,001 to $1,000.000 $1,000/Day Over $1,000,000 $2,000/Day The SCA expects to award up to two (2) contracts under this solicitation. Provided, however, that this Contract is one in a series of Job Order Contracts, some of which have or may have already been awarded or are in the process of being awarded. It is the intent of the SCA to have a separate contractor for each contract. While Bidders may bid on one or more contracts, the SCA, at its sole discretion, reserves the right to limit the number of contracts awarded to any one Bidder. The SCA and not the Bidder will determine which contract, or contracts, if any will be awarded to the Bidder based upon the overall best interest of the SCA. Two (2) contracts are expected to be awarded under this solicitation for the Not-to-Exceed amount of $25,000,000 each with a performance period of 1095 Continuous Calendar Days. Each bid must be accompanied by a Bid Bond along with its Power Attorney prepared by the bidder in the amount of $25,000, prepared on the form of Bid Bond annexed to the Construction Contract. Or in lieu of a bid bond a certified check or money order. Pursuant to the SCA's authorizing legislation, contracts will only be awarded to contractors prequalified by the SCA. If the Bidder is not prequalified at the time of the bid opening its bid will not be accepted. Please check all three (3) lists (disqualified, suspended, and otherwise ineligible) when conducting a search to obtain the complete prequalification status of a firm appearing on the SCA's Website at the following link: online. Bidders can ensure their eligibility for a contract award by verifying that they are currently prequalified. All inquiries regarding prequalification status should be directed to the SCA's Prequalification Dept. at (718) 472-8777. The successful bidder(s) will be required to furnish the SCA, Payment andPerformance/Labor and Material Bonds on the forms annexed to the Construction Contract in the amount of $4,000,000 immediately upon receipt of the Notice of Intent to Award Letter. The cost of the Payment and Performance and Labor and Material Bonds are to be included as part of the adjustment factor.
