A deficiency related to the failure of a listed, protected subcontractor to be prequalified with CDB will be considered a technical deficiency, as opposed to a material deficiency. A bidder will be allowed to cure such deficiency within seven calendar days of notice by selecting a protected subcontractor that is properly prequalified with CDB, licensed and certified, to perform the identified trade. A decision by the bidder to utilize a different protected subcontractor than that originally listed, shall not affect bid price.
