The project improvements are shown on the plans D-4720, LD24-052 included in the bid package. The Work to be constructed is located on the West side of East Indian Rock Road at Nicole, along the frontage of 247-259 E Indian Rock Road in the City of Vista, California. The Engineer's Opinion of Probable Construction Cost for this Project is two hundred thousand dollars ($200,000). All Work shall be completed in every detail to the satisfaction of the Agency within One hundred and fifty (40) Working Days after the date of the NOTICE TO PROCEED. In accordance with the provisions of the California Public Contract Code Section 3300, the Agency has determined that the Contractor shall be required to possess a valid California Class A General Engineering Contractor License at the time that the Contract is awarded, and shall maintain said license(s) in good standing at all times during performance of the Work. A Pre-Bid Meeting will not be held for this project. The undersigned hereby submits either a Bid Bond or Bid Security in the form of Cash, a Cashier's Check, or a Certified Check, using the forms included in these Bid Documents, properly made payable to CITY OF VISTA, hereinafter designated as the Agency, in an amount that is at least ten percent (10%) of the total base bid amount. The Bid Bond or Bid Security is attached hereto and is given as a guaranty that the undersigned will execute the Contract and furnish the required bonds if awarded the Contract and, in case of failure to do so within the time provided, the proceeds of said bond or bid security shall be forfeited to the Agency. The Surety's liability to the Agency for forfeiture of the face amount of the bond shall be considered as established. Except as otherwise provided in the Contract Documents, a bidder to whom the Contract is awarded shall, within the time stated in the provisions for "EXECUTION OF CONTRACT / FAILURE TO EXECUTE CONTRACT" herein, furnish a bond with an admitted corporate surety, or corporate sureties conditioned upon the faithful performance of the said bidder of all covenants and stipulations in the Contract. Said bond, hereinafter referred to as the Faithful Performance Bond, shall be in the form approved by the Agency and in the penal sum of at least one hundred percent (100%) of the total base bid amount payable under the Contract secured by two (2) or more sufficient sureties or by a surety company. Within the time mentioned in the preceding paragraph, the bidder to whom the Contract is awarded shall also furnish a Payment Bond, approved by the Agency, in accordance with the provisions of Civil Code Section 3225-3228, inclusive, and Sections 3247-3252, inclusive. Unless otherwise specified in the Contract Documents, said Payment Bond shall be in a sum not less than one hundred percent (100%) of the total amount payable by the terms of this Contract, but not less than the sum prescribed by Section 3248 of the Civil Code, in any case.
