The public works contract to be awarded for the Project shall be based on a timely submitted sealed bid for unit pricing, and said contract shall require, among other things, that: (a) construction shall be completed timely and in compliance with the County's plans and specifications for the Project, and shall include all materials, equipment, labor, services, and work necessary to finally construct and complete the Project; (b) the Project shall require the execution of a performance bond and payment bond as required by and in compliance with Chapter 2253 of the Texas Government Code, Chapter 262 of the Texas Local Government Code, and other authority; (c) the Project shall require that certain liability and workers compensation insurance coverage be obtained by the successful bidder in favor of the County; (d) compliance with certain termination, default, warranty, administrative, and reporting requirements described in the bid documents; and (e) payment by the County for construction of the Project shall occur through current County revenues with a 10% retainage as described in the bid documents. At that meeting or a subsequent public meeting, the Commissioners Court may award a public works contract for the Project as allowed by law to the responsible bidder who submits the lowest and best bid; however, the Commissioners Court reserves the right to reject any and all bids for the project and may rely on all protections afforded the County within the competitive procurement procedures allowed by law. McMullen County Commissioners Court ("Commissioners Court"), shall accept competitive sealed proposals for the following construction project ("Project") to be performed pursuant to a public works contract awarded by the County through competitive procurement procedures authorized by law: construction of "2025 Roadway Maintenance Project, McMullen County, Texas". The project includes the two-course surface treatment of portions of 5+/- county roads totaling approximately 12 miles throughout McMullen County.
