Failure to submit a qualification statement at least five (5) days prior to bid opening may result in the rejection of the bid. Prior filing of such form with the Village of Clinton or Consulting Engineer for the current calendar year shall satisfy this requirement. No bid can be received or considered unless accompanied by a Bid Bond or a Certified Check equal to ten percent (10%) of the bid, payable to the Village of Clinton, as a guarantee that, if the bid is accepted, the bidder will execute and file the proper contract and 100% Performance and Labor and Material Payment Bonds within ten (10) days from the date the lowest responsible bidder's bid is accepted. In the event the bidder fails to file such contract and bond within the time set by the Village, the check or bond shall be forfeited to the Village as liquidated damages. The Village of Clinton reserves the right to reject any or all bids and to waive or not to waive any informalities in the bidding. The letting of the contract described herein is subject to provisions of Sections 66.0901 of the Wisconsin Statutes. After bids are opened, no bid can be withdrawn for a period of ninety (90) days thereafter.
