The City reserves the right to reject any or all bids, to waive minor informalities or irregularities, and to award the contract to the lowest responsive and responsible bidder whose bid conforms to all material requirements of the Invitation to Bid. This work falls under the Davis-Bacon Act, as amended (40 U.S.C. 276a to a-7), and the Contractor shall supply the City of Fayetteville with certified payroll documentation. The Davis-Bacon and Related Acts will apply to contractors and subcontractors performing construction, alteration, or repair with federally funded or assisted contracts of $2,000 or more. Under this Act, contractors shall be required to pay wages specified in a wage determination made by the Secretary of Labor. In addition, contractors shall be required to pay wages not less than once per week. A current copy of the prevailing wage rates is included in the Project Manual and Contractor shall attach a copy of his certified payroll to his payment applications. The award of contract shall be conditioned upon the acceptance of the wage determination. The City of Fayetteville encourages Section 3 Firms to respond. TAX-EXEMPT PROJECT NOTICE: This project is being constructed under contract with the City of Fayetteville. Materials that become a permanent part of the work are exempt from North Carolina sales and use tax pursuant to N.C. Gen. Stat. 105-164.14(b). Bidders shall exclude sales tax on exempt materials from bid prices. See Special Provisions for details. Bidders are responsible for monitoring this site for addenda and other pertinent documents. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the bidder's date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. The Owner will not be responsible for full or partial sets of Bidding Documents, including Addenda, if any, obtained from sources other than the Issuing Office. FEDERAL FUNDING NOTICE This project is funded in whole or in part with Community Development Block Grant (CDBG) funds from the U.S. Department of Housing and Urban Development (HUD).
