Project Name: Elkton WWTP Raw / Influent Pumps Replacement Project. The project includes the complete replacement of all three influent/raw pumps and six (6) 12” gate-valves located at the Elkton Wastewater Treatment Plant, Elkrun Township, Section 20 of Columbiana County, Ohio. The goal of this process is to utilize a procedure that is fair to all parties, to provide a means to resolve disputes administratively, and to expedite dispute resolution. The Prime Contractor must exhaust this process prior to filing an action in the Columbiana County Court of Common Pleas. These procedures do not compromise the Prime Contractor's rights to seek relief in the Columbiana County Court of Common Pleas. All parties in the dispute must follow the specified steps. Disputes and claims of subcontractors and suppliers against the County may be pursued by the Prime Contractor if the Prime Contractor is in agreement with the dispute and/or claim. Disputes and claims of subcontractors and suppliers against the County but not supported by the Prime Contractor will not be reviewed by the County. Disputes and claims of subcontractors and suppliers against the Prime Contractor will not be reviewed by the County. Disputes and claims subject to review by the County include the following: 1) Interpretations of specifications, standard drawings, plans, the proposal, working drawings, change orders, and orders by the County Officials having jurisdiction over the project. 2) Differing site conditions as defined in the current ODOT C&MS 104.02 (B). 3) Cost and time incurred by: a. Suspension of the work under the current ODOT C&MS 104.02(C). b. Significant changes in scope of work under the current ODOT C&MS 104.02 (D). c. Utility interference with the work under the current ODOT C&MS 105.07. d. Extra work ordered under the current ODOT C&MS 104.02 (F). e. Acts or inaction of the County. 4) Adequacy and constructability of the plan design. 5) Contract time extensions due to weather, shortages of labor, equipment, or materials, or other causes beyond the Prime Contractor's control. 6) Other subjects mutually agreed upon by the County and the Prime Contractor to be under the scope of the dispute resolution and claims management process. The dispute resolution and claims management process for this project will follow the guidelines listed below: 1) The Prime Contractor shall notify the County Inspector as soon as he learns of circumstances that are likely to generate a dispute or claim. The Prime Contractor shall waive any part of the dispute or claim incurred after learning of the circumstances and failing to notify the County Inspector. 2) Prime Contractor disputes or claims involving minor quantity adjustments can be approved by the County Inspector in the field. Any necessary quantity adjustments that are agreed upon will be noted by the County Inspector and the Prime Contractor shall initiate a Change Order on the form provided by the County. The County Inspector can make this type of determination on a daily basis.
