Owner will evaluate and rank each Proposal with respect to the selection criteria using procurement procedures that conform to Texas Government Code Chapter 2269 to determine which Proposal offers the best value; however, Owner reserves the right, after evaluation of all Proposals received, to make no recommendation to its Board of Directors regarding award of a Contract in the event non-responsive, non-conforming, incomplete, unqualified or otherwise unacceptable Proposals are received, or if budgetary constraints or other unanticipated factors exist. No Proposal may be withdrawn until the expiration of 60 days from the date Proposals are opened.
