This project requires a contractor to provide and install all new materials, labor and equipment required to make the street improvements utilizing the street reclamation process in accordance with project specifications and standards. Contractor shall acquire as a part of this proposal all permits required and perform all testing required for this project. Work shall be performed in accordance with all City, local, state, and federal regulations as required for performing this type of work. The project is for a one year after Notice to Proceed is given. Each bid must be accompanied by cash, certified or cashier's check, or a bid bond prepared on the form of the bid bond attached hereto, duly executed by the BIDDER as principal and having as surety therein a surety company approved by the OWNER, authorized to do business in the State of Texas, in the amount of not less than five (5%) percent of the bid. Such cash, checks, or bid bonds will be returned to all except the three lowest BIDDERS within fifteen (15) days after the opening of bids, and the remaining cash, checks, or bid bonds will be returned promptly after the OWNER and the accepted BIDDER have executed the contract or if no award has been made, within thirty (30) days after the date of the opening of bids. The bid security will be returned upon demand of the BIDDER at any time thereafter, so long as he has not been notified of the acceptance of his bid. The OWNER reserves the right to reject any or all bids and to waive informalities and irregularities in bidding. Contract award will be made to the responsible bidder who, in the OWNER's judgment, will be most advantageous to the OWNER and result in the best and most economical completion of the project.
