It shall be the responsibility of the Contractor to ensure that the operations do not interfere with the functioning of the sewer, in accordance with the Bidding Documents prepared by the Engineer. Each Bid shall be accompanied by a certified check or bank draft in the amount of 5% of the total amount of the Bid, payable without condition to the Township of Macomb as security for the acceptance of this contract. A Bid Bond in the amount of 5% of the total amount Bid issued by an approved Surety Company and executed by the Bidder, may be furnished in lieu of a certified check. Macomb Township reserves the right to accept any Bid, to reject any or all Bids, to waive defects in the Bids, and to make the award as may appear to be to the best interest of Macomb Township. No Bid may be withdrawn after the scheduled closing time for receiving Bids for at least sixty (60) calendar days. The following Specifications for Contract Work, as included, set forth conditions or requirements peculiar to the Work to be performed under this Contract. The Work to be performed shall be as described in these specifications. The method of measurement and basis of payment for Work performed shall be as indicated in the Bid Form and described in the following divisions. Under each item of Work listed in the Bid Form and herein described, the CONTRACTOR shall furnish: all labor and materials; tools, plant, equipment, supplies, and bonds; costs of heating, lighting, and power; tests of construction materials as required under any section of these Specifications; and all Work that may be specifically described and included in the following divisions (under the respective items, whether included in part of a pay item or otherwise specified) necessary to complete the Work in accordance with the obvious or expressed intent of the Contract.
