The project includes construction of concrete sidewalks, curb and gutter, curb ramps, and all other necessary appurtenances along Bell St. Bidders must submit a bid bond in the amount of 5 percent of the bid issued by an acceptable surety for contracts that exceed $100,000. A certified check or bank draft payable to the City of Hamilton, or negotiable U.S. Government Bonds at par value, may be submitted in lieu of the Bid Bond. Federally determined prevailing wage rates (Davis-Bacon and Related Acts), as issued by the Texas Department of Agriculture and contained in the contract documents, must be paid on this project. The successful bidder must not discriminate based on race, color, religion, sex, sexual identity, gender identity, or national origin, and must adhere to the grant recipient's Section 3 Policy for contracts and subcontracts over $100,000. The City of Hamilton reserves the right to reject any or all bids or to waive informalities in the bidding, and may award any combination of Bid Lots at its discretion. Bids may be held for up to 60 days from the date of bid opening for review and investigation. Contractors or subcontractors debarred, suspended, or ineligible for federal assistance programs may not participate in this project. This project is subject to the Build America, Buy America Act (BABA) requirements. All iron, steel, manufactured products, and construction materials used in the project must be produced in the United States unless a waiver has been approved. The City of Hamilton encourages participation by Section 3 residents and businesses, as well as Minority Business Enterprises, Small Business Enterprises, Women Business Enterprises, and Historically Underutilized Business firms.
