The work included under these Specifications and the accompanying drawings consists of providing all items, articles, materials, operations or methods listed, mentioned or scheduled on the drawings and/or herein, including all labor, materials, services, equipment and incidentals for the construction of the Warren County New Broadband Communications Facilities project. This project includes selective demolition and new build-out of the tenant space formerly occupied by J. C. Penny Co. at the existing Three Star Mall in McMinnville, Tennessee. The Architect and Owner have attempted to identify all scopes of work; however, all incidental parts of the work may not be identified in the documents. All collateral or accompanying work required in order to accommodate work specifically shown in the documents shall be included in the Contractor's bid and shall not be cause for issuance of change orders. Sealed bids are invited for the Warren County Broadband Community Facility in McMinnville, Tennessee. Prospective bidders or contractors may examine the bid documents at specified locations and may obtain electronic access to the bid documents from the Architect upon request. Addenda will only be issued to bidders or general contractors who have registered with the Architect and/or attended the Pre-Bid Conference. A Pre-Bid Conference is scheduled and general contractor bidders are strongly encouraged to have a representative present. Each bid must be accompanied by a bidder's bond or a cashier's check in the amount of 5% of the bid amount. The successful bidder will be required to execute a Performance and Payment Bond in the amount of 100% of the contract price, or provide other security as described in Tennessee Code Annotated 12-4-201. Bonds must be accompanied by Power of Attorney. Bids will be awarded based on the "lowest and best" as prescribed by law, with the determination of "best" reserved for the entity requesting the bid. No bidder may withdraw their bid for 60 days after the date set for opening the bids. Warren County reserves the right to accept or reject any or all bids, to waive informalities, and/or to abandon or postpone the project without obligation to bidders. In the event of tie bids, Warren County reserves the right to negotiate. Bidders must submit an affidavit confirming operation of a drug and alcohol testing program at least as stringent as that required by Warren County. The institution is an equal opportunity provider and employer, and adheres to all applicable civil rights and drug and alcohol testing regulations.
