Proposers shall submit their Proposals and all documentation required by this Request for Proposals in one complete package to the Construction Manager at Risk. Failure to include any part of the requested information or documentation may result in the disqualification of the Proposer. The time stipulated in the proposal documents for the completion of the work is an essential element of the contract. It is mutually agreed that Abernathy Independent School District and the Construction Manager at Risk will suffer financial damages in an amount not now possible to ascertain if this work is not completed on schedule, and in view of these facts, it is agreed that the Construction Manager at Risk will withhold from the successful Proposer, as liquidated damages and not as a penalty, the sum as designated in the Proposal for each calendar day that the work remains incomplete beyond the date specified for the completion of the work. Contracts will be awarded on the basis of the lowest responsive proposal complying with the conditions of the Proposal Package provided it is in the best interest of Abernathy Independent School District and the Construction Manager at Risk. The Construction Manager at Risk, however, reserves the right to reject any and all proposals and to waive any informality in proposals received whenever any such rejection or waiver is in the best interest of Abernathy Independent School District and the Construction Manager at Risk. The Construction Manager at Risk and Abernathy Independent School District reserves the right to accept or reject any or all Proposals, and to waive any and all formalities.
