Each Proposal shall be accompanied by an acceptable form of Proposal Guaranty in an amount equal to at least 5% of the amount of the Proposal payable to the Town of Sentinel as a guaranty that if the Proposal is accepted, the BIDDER will execute the Contract and file acceptable Performance and Statutory Bonds within 10 days after the award of the Contract. The Town of Sentinel hereinafter called the OWNER, reserves the right to reject any or all Proposals and to waive any formality or technicality in any Proposal in the interest of the OWNER. Each Proposal shall be accompanied by a Certified Check or Bid Bond, in an amount equal to 5% of the Proposal, payable without condition to the OWNER as a guaranty that the BIDDER, if awarded the Contract, will promptly execute the Agreement in accordance with the Proposal and the other Contract Documents, and will furnish good and sufficient Bond for the faithful performance of the same, and for the payment to all persons supplying labor and material for the work. The Proposal Guaranties of all BIDDERS except the three lowest will be returned promptly after the canvass of Proposals. Bid Bonds shall be secured from a Surety Company listed in the Federal Registry, Department of the Treasury, Fiscal Service Listing. The successful BIDDER, simultaneously with the execution of the Contract, will be required to furnish a faithful Performance Bond in an amount equal to 100% of the Contract Amount and a Statutory Bond made payable to CLIENT equal to 100% of the Contract Amount; said Bonds shall be secured from a Surety Company listed in the Federal Registry, Department of the Treasurer, Fiscal Service Listing. Liquidated damages for failure to complete the work within the time specified shall be assessed at the rate of $250 per day for each additional calendar day until the work is completed. The CONTRACTOR shall provide a 1-year Maintenance Bond for all improvements in the amount of 100% of the Contract Cost of improvements. If awarded the Contract, the UNDERSIGNED agrees to complete the work within 120 calendar days of the commencement of the Contract Time as defined in the General Conditions of the Contract.
