All submissions must conform to the following general instructions: Proposals must be submitted through the NMSU online bidding system by the indicated deadline and should not exceed thirty-five single spaced, single sided letter sized pages in a font no smaller than 12 point, with certain attachments and forms excluded from this limit. Requests for clarification should be promptly submitted to NMSU Procurement Services, which is the only authorized contact for questions. Unsolicited contact with other NMSU personnel is grounds for disqualification. Any addendum will be issued through the online bidding system by the deadline for addendum. Respondents are responsible for submitting responses in advance and bear sole responsibility for technical issues to meet the deadline. NMSU may extend the submission deadline by written addendum, cancel or modify the RFP at its discretion, or reject any proposal in whole or in part. Any proposed exceptions to the scope of work must be explicitly noted in the Letter of Transmittal. Proposal amendments must be complete replacements, clearly labeled, and submitted before the deadline. NMSU may waive technical irregularities that do not alter price, quality, or quantity. Costs related to the RFP process are borne by the Respondent. Selection of a Finalist does not obligate NMSU to enter into an Agreement. Proposals are confidential until an Agreement is entered, with exceptions for information claimed and marked as proprietary or confidential, limited to specific types of data. NMSU will select the Responsive Proposal(s) most advantageous and in its best interest. Certain governmental entities in New Mexico may contract with the Contractor under terms of the Agreement, but NMSU is not a party to such contracts. Debarred or suspended Respondents will not be considered. Submission of a Proposal certifies that the Respondent has not acted in restraint of competition. Preference points may be awarded to resident or veteran businesses as specified. All applicable State laws and regulations apply to the contract and the laws of the State of New Mexico will govern.
