The Contractor shall furnish all labor, insurance, equipment, materials, and power for the complete performance of asphalt pavement patching on various local and collector streets throughout the city, in accordance with the Bidding Documents as prepared by City Utilities Engineering Department, City of Fort Wayne, Indiana. No bid will be accepted from, or contract awarded to any person, firm, or corporation in arrears to the City of Fort Wayne, Indiana, upon any debt or contract, or who has failed to execute, in whole or in part in a satisfactory manner, any contract with the City, or who is a defaulter as to surety or otherwise, upon any obligation to the City, or is engaged in litigation with the City. The successful Bidder will be required to furnish a satisfactory Labor and Material Payment Bond and Performance Bond each in the amount no less than one hundred percent of the contract price. The Board reserves the right to reject any and all bids for failure to comply with applicable laws and/or with the Instructions to Bidders and to waive any defect in any bid.
